County Court Claim - NCP Parking outstayed by 20 mins

  • My plan is to then draft my defense after the AOS is submitted I will do whats suggested altering only paragraphs 2 and 3 as suggested by @Le_Kirk (thank you).  From other discussions I thought there was substance to the inflated charges for such short additional parking time (20 mins) or should this just be left out of the arguement?  Do you suggest I focus on what happened which led me to overpark by this amount of time?

    There are no inflated charges due to any alleged overstay , grace periods cover such issues

    The inflated charges are already in the template defence (  no S in the word Defence !!  )

    There should be no admissions in a defence , the defence is denying the claim

    With a Claim Issue Date of 10th February, you have until Monday 1st March to file an Acknowledgment of Service, but there is nothing to be gained by delaying it. 
    To file an AoS, follow the guidance in the Dropbox file linked from the second post in the NEWBIES thread.

    Having filed an AoS, you have until 4pm on Monday 15th March 2021 to file your Defence.
    That's four weeks away. Plenty of time to produce a Defence, but please don't leave it to the last minute.
    To create a Defence, and then file a Defence by email, look again at the second post on the NEWBIES thread - immediately following where you found the Acknowledgment of Service instructions.
    Don't miss the deadline for filing an Acknowledgment of Service, nor that for filing a Defence.

    County Court letter received Thurs 11th Feb dated Weds 10th Feb, I have obtained all information from NCP via email against  my name and registration number.

    Why do you say this?
     I got a parking ticket from NCP for over £100 for outstaying my 1 hour, they had footage of me leaving about 20 mins after the hour I had paid.  Based on information on here I ignored all letters 

      We haven't told people to ignore private PCNs since 2013.  Eight years ago.  You could have had this cancelled with one email. So frustrating.

    PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

    @Redx and @KeithP Ok I submitted the AOS last friday (26th Feb) I believe I have until 4pm Monday 15th to submit my defence.  I have tried to keep it simple and read through guidelines could you both be so kind as to read and provide any feedback thanks so much in advance!

    2.       It is admitted that the Defendant was the registered keeper of the vehicle in question but liability is denied.  

    3.       The defendant returned to their car within the 1 hour paid duration, upon entering their car they realised that their wallet was not in their bag.  They then checked under the car foot well to see if it had fallen out, upon realising it wasn’t in the vehicle they retraced their steps along the car park and down to the main high street to try and locate their wallet.  They then went to the last store they had visited where the wallet had been used.  Upon visiting the store the defendant was told by the security guard checking after that a wallet had indeed been handed into customer services.  The defendant provided details of what was in the contents of the wallet to the customer services desk to validate identity and left the store with the wallet to return back to the car.  The defendant entered their car and left the car park relieved that the wallet had been located to return home.

    2 should state keeper and driver , if you are defending as driver , as suggested in 3

    Vehicle is definitely better than car
