We are not interested in when you had the court letter , we want to know the issue date on that court claim letter
Answer what we ask you , not what you believe we need
No good crying over spilt milk in not replying to an LBC , deal with the here and now1 -
12th Feb I presume? Date means a full date. Always.
So yes, you gave a full name and full serviceable address for the driver?. You know that this is court, so we are asking you to be precise for a really good reason. So do us a favour and be precise from here on out
You can just explain that you didnt respond as why would you - the driver had been named.
Yes, the right direction is as you have been told - follow the newbies thread!
It has a complete defence template for you to adapt just para 2 and 3, but you must in para two add a single line stating that you were the Keeper but not the driver, and in para 3 you will state you informed the Claimant of the drivers full name and serviceable address, using EXACTLY those words, on DDMMYYYY date. The claimant therefore has no cause to chase, you, the keeper for the drivers alleged debt

I don't know if my MP could assist ?
Neither do we, why not try.
It is not a fine, continue to use that word and you will upset a lot of people here. This is a piddling parking charge from a company trying to scam you, treat it as an intellectual challenge, learn the rules of the game, put on a clean shirt, and cost them money. You never know how far you can go until you go too far.0 -
Redx said:So if you have replied to the NTK with the name and address of the driver you complied with POFA , so they are claiming from the keeper instead of the driver which is an extra point for you
You need to answer our other questions and follow our advice too
The second post of the newbies thread applies to court claims
Stupidly I sent the letter back in the post thinking it was the right thing. In my defence I had done nothing wrong so saw no reason to think this would come back to bite me! Thank you for being supportive; I'm having a tough time of things aside from all this and I'm really struggling to gather myself together.0 -

Stick to answering our questions for now , no more side issues , answer what people like myself and Nosferatu are asking , do it concisely , no stories , no sidetracking
Do the AOS tomorrow or later this week , online , on the MCOL website , no later than the weekend coming up
Email a SAR to the DPO at Britannia today , asap , with proof of I D , no Photo I D , a copy of the claim form is sufficient
Then start drafting paragraphs 2 and 3 and post them below , no more debate for now , no more side issues , do the important stuff1 -

It has nothing to do with right or wrong, the issue is, did you breach a civil contract or not. You are not dealing with John Lewis, do not exoect the PPC to behave rationally. Keep reading the newbies. You never know how far you can go until you go too far.1 -

What from the court states "driver"? What do you mean by "stating driver still!"?
- in whose name is the court claim form N1 in? Is it YOU or is it THE DRIVER?
- which letter did you send back?
STop for about 30 minutes. Read the posts again, and give us one post in response to all questions asked, so we can see this is one place. No need to quote. Spend some time properly formatting this response so we can see the question and your answer
If you keep flailing around its going to take 10 pages to getr the basic info we need.2 -
Thanks all! I am in work currently so I will get on with drafting a full response and reading the points you have made. I have a plan of action now and I am very greatful.
