    May I ask why? How do you feel I'm at fault here? Genuinely curious, not salty.

    Call me cynical but there's not a chance someone like yourself, who seems to recall every detail throughout this deal so well, drove away from the dealership not knowing they were under charged by two grand.

    I've not taken in the whole thread but it sounded to me like they mistakenly charged you £2k less than the agreed price (which you had already negotiated down) and you claim you did not notice that when you authorised the original payment?  Sounds a bit unlikely to me.

    I'd have walked away when they wouldn't allow me to do a test drive "because of Covid" but would let me try it out in the parking lot.

    Surely the waiver would have had no effect even if you signed it?  You can't waive your statutory rights.  (Can you?  Isn't that a criminal offence?).  The fact they are even trying this shows they are cowboys.  Get them reported to Trading Standards.

    High performance 12 year old vehicles not known for their reliability should be bought at leisure, not in haste. 

    Its a mess, one side needs to give in or be prepared to get lawyers involved.

    I recall every detail because it has been discussed (argued) so thoroughly between myself and the dealer all the way from the morning after I got the car home and called them up.

    I genuinely did not realise that the payment was short until I returned their missed calls while stopped at a Mcdonald's drive-through halfway home (over an hour away). At which point, I had left my card in my partner's car (I paid for the McDonald's on it) who had already left to go home. And I told them there and then that I would call them and pay the rest as soon as I got home. I also did not realise at that point that the car was missing 6 of it's supposed 8 optional extras. The most important one being the Adaptive Cruise Control, which I really wanted :neutral:

    I paid the amount they charged to my cards. I was in a hurry and had a long journey home. Hence not checking the car over thoroughly for the optional extras.

    Although, I'm not sure any of this is actually relevant?
  • daveyjp has summarised it.  One party needs to back down or take legal action.  I doubt the dealership is going to do either, so that puts the ball in your court.

    I agree. And buying in haste was entirely my own fault.
    Although the XFR actually has a very good reputation for its reliability, especially the gearbox.

    Unfortunately, I don't think anyone is going to back down here. :(

    I'm just looking for peoples opinions on if having the car repaired at my own cost, will significantly impact my chances of a claim to the extent where it isn't actually worth doing it?

    When we bought our current car I paid £10k on a card and I double and triple-checked the amount was correct before authorising it.  You didn't?
  • I think it's a cleaner solution to let them have a chance to fix it.  If you get it fixed elsewhere and bill the dealer, their argument is that you haven't provided them the opportunity to inspect and fix it.  Of course, you would counter with the point that they are being unreasonable by asking you to pay more to do so.  That's messy.  Whichever route you choose, it's likely this is going to court (or at least the threat of court), so you need to decide whether you're going to be in a stronger position by backing down and dealing with the outcome of them looking at it, or taking it elsewhere and hoping you can successfully claim that other garage's costs.

    I genuinely didn't. The fact that it was split over more than one card, and there were card fee's complicated things slightly. But no, I didn't personally add up the figures there and then. I told them how much to take from 1 card. Put in my pin. Gave them my 2nd card. Put in my pin. Had them tax it. Signed the forms, went to the car, bought insurance in the car (already had a quote just had to click yes and put in my card details) and left.
