    Can you please confirm above? You have the paperwork in front of you. We dont. 
    There is no letter attached.

    Who is the letter from ? The court / CCBC? Does it state Notice of Judgment In Default? "the letter" doesnt give us any useful detail

    WHy did you approach the hotel in 09.2019? What precise named document did you receive, and from whom?
    Answer the questions given. Were on page two and youve failed to establish many salient facts.

    I'd be sending that email proof to ParkingEye by email:

    enforcement@parkingeye.co.uk

    ... and copying in the CEO of the Hotel group, and asking them to consent to set aside and to meet the £100 cost of the application to court, given that they assured the Hotel in September 2019 that the PCN was cancelled, yet obtained a CCJ a few weeks later, having failed to discontinue the claim, and having told you to 'ignore any subsequent letters'.

    C-M - from reading the OP has yet to confirm WHO said to ignore any letters
    There is a Hotel saying so, but we dont know if PE told the hotel that, or not.
    My guess is the hotel did so, and theyre not a party to the claim.

    I realised that and thought the same as you, however, I think by copying in the CEO of the Hotel, they can fight that out between themselves!  Maybe that 'advice' was only from the Hotel but it flowed from a promise that ParkingEye had cancelled the charge.

    Thus the D has a right to ask ParkingEye to provide a consent order and to cover the £100 cost of this CCJ set aside N224 application.

    Thank you for your advise. 
    I have since emailed the CEO, however they are away until the 28th of February. 
    Do you think I should file the N244 and then claim the money from the hotel? Or shall I confirm they will pay for the CCJ to be set aside first? 
    Also am I able to do a N244 without a solicitor? I enquired about getting a solicitor to help with the case- but those costs go into the thousands.

    I also requested the hotel send me all emails correspondence they had with PE. Unfortunately the manager who dealt with the case has left, and no one has access  to those emails.

    No, because a set aside with consent incurs £100 court fee, whereas you bunging in a N244 without consent costs you £255 up front.

    And of course someone reads a CEO's emails in his/her absence!  Just do the email I said, to BOTH ParkingEye and the Hotel. NOW.  Give them 14 days maximum to respond.

    Do you know what, I am not answering that...please read the forum; it's what it is here for.  Not only does the NEWBIES thread tell you how to get a CCJ set aside (with or without consent) but if you'd read a SINGLE set aside thread you;d know we do this every day of the week, with ordinary people filing set asides without fuss, and winning and getting their CCJs set aside pretty much every single time.


    You are typing as if you've read no set aside threads.  Put that right and you will grow the confidence & knowledge you need.

    I have a question for the Draft order:
    "Should the court reserve costs in the case as an alternative to paragraph 2, such costs of this application will become payable if the claimant discontinues it's claim"  what does this mean in layman's terms?
