Hi, new to this forum so forgive my ignorance.
Brief details - Received a "parking fine" last Feb for parking in a medical center car park. I was there for work purposes legitimately. There is a system there to log your vehicle details to avoid this. For some reason I didn't do this on this occasion. (I tried to contact the centre but this has proved difficult)
Anyway subsequently received a charge from Civil Enforcement. I tried to ring them at the time but couldn't get any response.
There was an option on there web site to submit a reply which I did. This included my job sheet. This seem to fault out and I have no way of telling if it went through or not.
I have subsequently received a number of letters escalating the case/cost. In my wisdom I have ignored all of these as I assumed they would eventually stop.
A couple of days ago I received a claim form and response pack from County Court Business Centre in Northampton and the cost has now gone up to £270.96.
What would be my next course of action, ignore this or deal with in a different way?
Any advice/guidance would be really appreciated.

No, you didnt receive a fine. Bet you £10 you didnt.
Good job you didnt ring them. Stupid thing to do with a parking firm.
Submit a reply - do you mean submit an appeal?

If you ignore this then you will have a default judgement against you, and a CCJ that will wreck your credit for 6 years
Have you found the newbies thread yet?

What did the manager/head of the medical centre say when you complained?

You need to get pics of the site and signage, outside and in.

Does the system require the visitor to enter vehicle details on a covid infected keypad, or does an employee of the centre do this for the motorist?
If the former, I don't blame anyone for not touching it. If the latter, was the motorist given the opportunity to verify the data before it was sent?
This may sound trivial, but I assure you that it is not.

You need to read this: -

URGENTLY and then take action, specifically can you tell us the date of issue of the claim form.  Regular @KeithP will be along to give you some deadlines.  This CANNOT be ignored.
  • Thanks for replies.
I have had a read through the newbie thread but struggling to find specific info regarding this.
The date of issue on the claim form is 29th January 2021.
Any advice would be greatly appreciated

    What info ?

You look at the newbies thread post 2

You email a SAR to the DPO at the PPC attaching a copy of the claim form

Then you do the AOS tomorrow or later this week

Then you adapt paragraphs 2 and 3 from the coupon mad defence template linked from the newbies FAQ sticky thread

Only an idiot or fool would ignore a live Court claim !!

You haven't even bothered to answer all the questions above ^^^

Don't ask questions if you won't answer any , it wastes our time !!

With a Claim Issue Date of 29th January, you have until Wednesday 17th February to file an Acknowledgment of Service, but there is nothing to be gained by delaying it.
To file an AoS, follow the guidance in the Dropbox file linked from the second post in the NEWBIES thread.

Having filed an AoS, you have until 4pm on Wednesday 3rd March 2021 to file your Defence.
That's over four weeks away. Plenty of time to produce a Defence, but please don't leave it to the last minute.
To create a Defence, and then file a Defence by email, look again at the second post on the NEWBIES thread - immediately following where you found the Acknowledgment of Service instructions.
Don't miss the deadline for filing an Acknowledgment of Service, nor that for filing a Defence.

So much of this going on lately. I just give it one shot, from then, it's up to the OP!
Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

  • Ok, thanks for replies.
Regarding earlier questions about vehicle entry details. This is done by the visitor and I didn't do it! (it's pre-Covid anyway)
I was visiting as a service engineer on a tight schedule and so in my haste didn't enter my details. I was there for under half an hour.
I don't have any pictures of signage or the site as it is over an hour away and not somewhere I visit often.
I tried to contact the manager to no avail at the time, but will try again now it has escalated.
I will email the DPO at Civil Enforcement Ltd with an amended copy the SAR from coupon mad's post.
I will check tomorrow what solicitor CEL used earlier and then and email them requesting a delay on the case
I will fill in the AOS and send to County Court Business Centre.
Is there anything else I need to do?

The SAR goes to the DPO at CEL , nobody cares which solicitor they used. You cannot tell anyone to put it on hold , it's a live court claim

Do the AOS now , tonight , online , logging in with the reference on the bottom right of the claim form , Do not send anything off , nothing is posted , follow the AOS guide in the Dropbox link. , do not put anything at all in the online defence box , nor the paperwork that arrived

Name the location in case it's come up before
