yeah you guys are right to be honest... i am just stressed about it all
the next step is for me to reply to DCB Legal, as you have all highlighted i should not reply using the forms, can someone help me structure an email or letter and also a email address or postal to send to?
1- deny all debt
2- seeking legal advice (unsure if i need this point as i dont need extra time as i have SAR)
3- ask for what legal grounds there are working on to add unknown amounts to the fine..
i dont meant to disregard what you guys are saying but it seems the reply form already have boxes for me to put all of the above - dispute it, option to tick legal advice and also extra information box what is the point of sending a separate letter other than the pure fact of its a form issued by them?0 -
I would ask for the 30 day hold but also timed carefully, to respond to DCBL on the last day the LBC states.
Unless you really want a claim form winging its way to you just before Xmas? Surely January will be a clearer month unless you celebrate something else then, as I know some religions do.
A sign opposite a roadway never relates to the opposite kerb on street (going by proper Council rules). So there is no reason, if stopping on a completely unmarked kerb, to seek out a sign opposite. This isn't a car park, it's an access road and they should have marked it properly if they wanted contractual terms to apply to that kerb.
How would a driver even know that road is private land, managed by an AOS member?
Also, predatory pics across 2 minutes flat doesn't discount that the driver was just loading, unloading, or assisting a passenger to or from nearby premises, none of which is parking (JOPSON v Home Guard).
Also, the sign is forbidding and makes no offer because there is no consideration on offer (nothing of value).

yes i am going to wait and see if they take me to court and i will fight it if so.
however i am still struggling with the letter which i should send to DCB Legal in response to the letter of claim (LBC) , i found the postal address which is fine.

I again refer to what coupon-mad says above. She should know, she has zapped these scammers many times
This is a game we play every day. DCBL are nothing special and if they are stupid enough to take this one to court, it will cost UKPC money which they can ill afford
Over to you UKPC, you already know the disaster that DCBL can bring, time to wake up ?

As UKPC have stated that you can't park there, how on earth can they then turn around and say that there is any contract in place between them and the motorist?2 -
