But surely members of the public/motorists are given unshakeable confidence because of:-"Compliance Monitoring ProgrammeThe compliance monitoring programme offers practical advice and guidance to members, whilst delivering regular site assessments and operational audits and addressing compliance issues that have arisen from complaints made by members of the public.Because only the most professional and reputable operators will be able to satisfy the rigorous compliance criteria, the scheme will enable these members to set themselves apart as operators at the level of ‘Best Practice’. Over time therefore, ownership of the AOS logo, the Safer Parking Scheme logo, and membership to the BPA will help members to provide a feeling of safety and confidence for motorists when they choose to use a car park that is identified in this way."
My bucket certainly overfloweth (sic) knowing the above.5 -

You are right on terminology, but a check on their behalf would negate the need to issue intimidating and threatening correspondence. I'm not getting fined for non payment, this it is not the case. I'm disappointed with the BPA response! The BPA gets paid by the PPC's not the public why would they be on the public's side? The BPA are a disappointment in almost every complain made to them I'm afraid for the above reason. You are not getting "fined" for anything.
You realise at some point you are no longer able to progress this - you are waiting on them?
The BPA do not care about consumers. Not really, and certainly No more than they need to do to not have their status as an ATA revoked. They care first and foremost about their members, as their members pay the bills, not you5 -

To do the simplest of checks to prove my account will not cost them, this is so wrong.
Their ANPR will mirror exactly to their machines records!
Not holding up much hope if my last option is Popla, if trading standards and the MP doesn't get them to check.
Scamming in broad daylight, so wrong!1 -
Not holding up much hope if my last option is Popla, if trading standards and the MP doesn't get them to check. The chances of anything happening before your POPLA deadline are pretty slim. Don't miss that deadline. Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .
I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

It will cost them £60 or £100 (the scam) the land owner got your £4 Euro didn't.

Received an email from Gemma Dorans at the BPA of my appeal for Euro Car Parks to simply check their machine for my repeated attempts to enter my reg and the additional £4 which they will find I entered at the time. The BPA has a Code of conduct, it seems to me to just be an exercise in writing words.
Dear Neil, Thank you for your reply, the contents in which have been noted. Please note as we are not a regulatory body we are unable to investigate individual ticket disputes or handle appeals. You invite us to check the ANPR cameras against your account but this is outside of our remit as we do not have access to this information.
POPLA was set up to deal with disputes of this nature. POPLA are an independent appeals service and if you want to contest the charge further, you should follow this process.
I am sorry we cannot assist you directly on this occasion.
Kind regards
ThanksGemma Dorans

I've replied :
Hi Tina. Thank you for your reply.
Forgive me if there is a slight misinterpretation in the wording. Euro Car Parks have not sent me debt collection letters, they intimate very strongly that if I do not pay them, i.e. refuse, they will take all necessary steps which may include court.I am not refusing to pay, i have paid. I have paid more than double for parking, a simple check of their machine or records will prove 100% of my repeated reg entries and for a £1.50 car parking fee, I entered a total of £4.They have ignored this fact that would clear this up immediately. This is my reason for contacting you.RegardsNeil
Popla draft in the making, and awaiting my MP's reply, but not feeling confident at present :-(1 -
You should feel confident, we have a very high success rateYou never know how far you can go until you go too far.1

I can't understand why you thought the BPA would have access to anpr records of hundreds of individual car parks but any complaint about their scamming members is worth doing.Don't fall into the trap of thinking POPLA with act on anything about you over paying they won't even consider it, of course the BPA give you no clues in their reply on what to use in your appeal. The theory is that the PPC consider your appeal fairly and look at mitigating circumstances and in your case the facts of what happened with payment, and POPLA consider the way the PPC have operated from a law/procedural/signage etc point of view.In reality the PPC wants money and doesn't consider anything, POPLA will side with their paymasters if at all possible so do the BPA.Citizens advice are hopeless with anything to do with car parking, all very predictable.5
