I received a parking 'fine' from 'Smart Parking Ltd' after a short break in Cornwall. Looked online and the car park is notorious for sending tickets (using ANPR) to people who for instance had gone into the car park at peak time, drove round looking/wating for a space and when unable to find one, have driven out and then been issued with a ticket. My case is different in that we did park and pay. We arrived in the car park at 11.47, I left the car to go to the ticket machine (it was very busy and there were lots of people around all trying to work out payments etc. I decided to pay by RINGO so downloaded the app. paid until 3pm and went to meet family on the beach. We arrived back before the ticket ran out and we are photographed driving out of the car park at 15.01 I have evidence (my RIngo receipt) that I had paid from 12.01 to 15.01 and explained this to appeal to POPLA which was of course dismissed. The only thing i can think of is that they are trying to charge me for the time I was queueing to check instructions and then downloading the app (bad signal took ages) which would have meant paying retrospectively to park - which you can't do. I have now received my second letter from DRP - I have not replied to them and have no intentions of doing so but this is making me feel ill. I have a health condition and also a carer for my husband so really don't need this on top of everything else0

@JJ58 - you need to read the NEWBIES FAQ Announcement, fourth post, to learn all about debt collectors. In short, debt collectors can be ignored. If you need any further advice, you need to start a new thread of your own please. Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .
I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.
