Sent SAR to Parking Company, they're requesting my driving license - how to proceed?

Hi Everyone,

First of all, thank you for all of this information it's incredibly useful!

As the title says, I followed the information given in the Newbies Thread and sent an SAR to the original parking company, they've gotten back to me today asking I fill in an attached form (to the email) asking for lots of information, such as DOB, date/time/location of the incident, tick whether I was the driver at the time of the incident, AND copies of my driving license, a utility bill and confirmation from the DVLA that I was the registered keeper of the vehicle at the time of the request.
They then go on to say until I give them this information they cannot give me the information I have asked for.

I read in the Newbies Thread that I do not have to provide this information, but it seems like they're asking for a lot of information there from me (not to mention the request that I tick to say whether I was the driver) so how do I now respond?

Also - the parking fine was from 5 years ago, I no longer own the car (haven't for a very long time) and am not sure if I need proof from the DVLA and if so, how I would do that!

Thanks so much.

Name the parking company for a start

Do not give them any details or personal data of yours

    So no driving licence

    No passport

    No date of birth

    No telephone number

Do not reveal who was driving

You don't need DVLA proof , they need that because they issued the pcn

Send them 2 recent redacted copies of utility bills , like energy , council tax etc , hiding references and amounts of money etc , but leaving the name , address and date showing , plus showing who sent it too , cover up all personal data (they already know your name and address so leave them and the date showing etc)

Also add any copies of any LBC or court claim too , because they issued them to you at your address

Setup a free Gmail email address for this saga , give them that too , so not your personal email address

Do as advised above. Include any reference numbers such as PCN number that they have previously given to you. Point out that the ICO does not require you to provide the information requested, only that you provide enough proof that you are the data subject.
If they insist you provide the information already requested, and/or refuse to respond without it, then complain to the ICO.

    What stage are you at?
In which Nation within the UK do you reside?
Where did the alleged event take place?
Assuming you know or can remember the above, what happened when you complained to the landowner.

It's Group Nexus who are the parking company, with DCB Legal acting as the solicitor who have sent me the Letter of Claim.

I thought the DVLA request sounded bizarre? As in, they want me to prove to them that I am liable...? Erm, seems like that's your job.

I'll reply to them now. Is there any kind of way of phrasing this you would recommend? Such as 'As per the standard SAR procedure, I am not obligated to provide you with any of the information you have requested with the exception of a utility bill which I have attached. You have my address as I have received your Letter of Claim, and the quoted reference number for your Company is XXXXXX. With only this legally necessary information provided from myself to prove I am the correct person you've intended this letter towards, I will now await your response with the information have requested.'

    Something like that?

Something like that yes , but with more than one utility bill copy , ideally copies of their letter to you at your address , copies of at least 2 utility bills as well , I would also breference the DPA 2018 GDPR law and lastly I would state that if they fail to follow that law you will report them to the ICO because they are asking for extra personal data that they are not allowed to do

Add the PCN references plus any other identifiers they have used , location and dates are also ok

Ps , they have done this many times recently , to other people like you , read those threads and responses too

    Hi,

It's pretty far past the point of no return here... The original parking fine happened 11/9/15 (according to the letter) on the Roadchef Chester Services and I'm based in England.

I never raised a complaint with the landowner... I basically ignored any correspondence sent to me from the original parking company (CP Plus who have since been bought out by this Group Nexus) and when I received letters from debt collectors I ignored those too (They were received December 2015 as I posted on here then too in regards to them)

    Thanks

That's so helpful, thank you so much!!
I'll try and find some of those other threads. I'm imagining it's because it's coming close to the 6 year cut off?

Correct , they are sending out hundreds of these at the moment , before the 6 year deadline and lack of income due to the pandemic , so they have resurrected old invoices and are chasing them up , prior to a court case

Sometimes people get cancellations by the landowner even at this late stage , or a letter or witness statement backing them up. Moto have cancelled a few of these recently , so never say never , roadchef , Moto , a lot of these are owned by the same company , who don't want to alienate customers

    So awful   :(

I will email Roadchef later then, I have to go to work now unfortunately but I'll be chasing this up as soon as I get home tonight.

    Thanks again!
