UPDATE:
Emailed in claim form & telephoned money claims online - confirmed that they have received my entire defence and that the other party had failed to submit anything prior to my email.
Cheers all.3 -
This was your defence (I assume, not the claim form)?
And it was the whole template defence with only points 2 and 3 amended, not simply point 3?Jenni x4 -
Hopefully you emailed it to the ccbcaq email address , not the 122 lines on MCOL , plus the whole defence and not just those 2 paragraphs. KeithP gave you full instructions on 17th January !!
We appreciate what you are doing at work , but ALWAYS check your facts , even when not at work. You are doing a great job so keep it up !! 😊3 -

Thank you. Few extra hours rest today and feel better. Tragic thing is, the impact on the UK could have been stopped in March IF we had followed a 'Covid elimination' strategy and totally locked down (borders as well) for 2-3 weeks. Worked in other countries and they are back to (almost) normality. The fact we failed to do similar is galling to NHS staff.2 -
UPDATE:
Case defended - email sent through in time and confirmed with the courts. Form N180 received.
On a day off I read a letter from VCS in red capital letters stating "NOTICE OF RECOVERY" and highlighting that they had been awarded a CCJ against me on 12th February. The letter also threatened enforcement action and bailiffs. This was hugely distressing, and came during one of my worst weeks as an NHS professional.
I immediately rang the courts. The clerk advised that VCS had tried to seek a judgement on 12th February, however they were told that it was a defended claim.
VCS have thus mis-represented the decision of the court. I suspect that this is not uncommon.
Any advice on how to proceed?
Many thanks,2 -
Yes, the claim is live, so you proceed exactly as normal for now
You could try to kick up a stink with VCS but they'll claim an "admin error" and youre not going to get a court to care3 -
An 'admin error' even though there is 4 days between the court advising VCS that this was a defended claim and VCS sending their threatening letter?!nosferatu1001 said:Yes, the claim is live, so you proceed exactly as normal for now

Seems more like incompetence or deliberate misrepresentation. As a medic, I would expect my regulator to be reviewing me if I made such an error (honest).1 -
You can use it as an attachment with your Witness Statement later and at the hearing, to paint a picture of wholly unreasonable conduct, to try to get your full costs (hours of time) that are normally not allowed, but come into play of a party has acted vexatiously or wholly unreasonably.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Yep, admin. If the court sent a letter to VCS thats assumed 2 days for delivery, some processing time while COVID is putting staff out the office. Easily explained.2
