I predict it will go to court, or almost , it wont stop at MCOL and DQ stage, they will proceed IMHO, we have seen many get to a hearing, whether the victim likes it or not !

Hi,
Would acquiring an easement by prescription be relevant as I parked in the same parking space for 2.5 years before the PCN's were issued and 4years in total throughout my tenancy?
Thanks0 -
Easement by prescription is 20 years or more but includes previous residents of that property. But only if no signage unpicks the easement.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

No nothing earth shattering. They said I should have found alternative parking if I was waiting for my permit from vcs and basically that I didn't respond to a legal letter from dcb but I did email dcb and vcs and neither wanted to help. Said I could have contacted them but i Did several times and no one would listen to me. The first PCN I got they stopped court proceedings before the hearing and then 2 yes later came after me for the other 4.1

So it's hot air. In fact, just disgusting greed.
Basically saying that it's somehow your fault - a breach of contract by you, a resident with title or rights under your lease - that a non-title-holding 3rd party ex-clamper (VCS) withheld the permit, then penalised you for not displaying the permit they'd delayed.
Making the term on the sign void for impossibility. Would be clever if it wasn't such an outright scam against residents.
It is as easy as pie for any professional parking firm to add VRMs to an electronic whitelist as soon as someone buys a new car or moves in, if they really wanted to provide a fair service to residents rather than treat you all like they are shooting fish in a barrel.
The situation in your case is appalling and they have the cheek to say you should have parked elsewhere?!My car was stolen from my
apartment block during the Xmas period 3 yrs ago and my parking permit was in the car. I had to wait for my permit to be resent to me and I was told my car would be exempt from any fines from VCS. I was fined 5 timesIf anyone has breached their contract it's them. A canny Judge will see right through this scam.

Hi All,
I had my court hearing today and won :-) Thank you for all of your help and advice. 3.5 years of being chased and it's finally over!

Excellent, when you have descended from cloud nine, could we have some details please, sometimes called a court report, where, which judge and why you won. Did you ask for and were awarded costs?2
