I'm totally on the side of the OP. I'm not sure why everyone has jumped on them so quickly. They were driving, within the limit, someone pulled out without checking it was clear. Totally the third party's fault, no 50/50 about it.chrisw said:Hmm, I'm a bit more on the side of the OP.

More people might be on the side of the OP if they didn't keep changing the story and drip feeding information.
Firstly there was no mention of any injuries then a mention of an injury was added later.
They also stated that they logged the incident with the police but now are saying that the police attended the scene.2 -

Road conditions were well lit completely clear and dry with a side of inconsiderate idiot pulling out without looking or having a working mirror ... sorry for not anticipating it0

That's why the Highway code states:"The speed limit is the absolute maximum and does not mean it is safe to drive at that speed irrespective of conditions. Driving at speeds too fast for the road and traffic conditions is dangerous

The legal requirement is to drive at a safe speed, within the limit, taking into account the conditions and circumstances. In some circumstances it may be safe to drive right up to the speed limit, in other circumstances walking pace might be too fast!0 -
