Being Charged a restocking FEE Help! Paypal Credit

    So I refuse the refund and they send the card back to me?

    You desperately don't want to understand do you, even though it has been explained several times.
    The value of the product to the retailer, where you got it from, is as a complete, packaged product that someone can buy, off the shelf. If part of the packaging is missing then they can't sell it in the same way that they could to you.
    And the restocking fee? They pulled it from their Terms and Conditions, which you agreed to by buying from them.
    Is that a simple enough explanation for you?

    I can see that this thread is going to go round and round the same circle, because you obviously want to hear someone say that you can choose which bits of a product you return and which you don't.

    it is appreciated that you think its inconsequential but you were sloppy in your return and therefore you've been caught out.

    The fee represents their admin time and likely loss for selling an incomplete item.

    There is no mention of a 21% restocking fee in their terms and conditions....by this notion the online retailer could charge 21% restocking fee for slicing the box tape open....
    No I’m no mug and won’t be falling for a generic restocking fee pulled out of their backsides...I need an explanation on how they came to the conclusion that the item is reduced in value by £146.79 and where it actually states a 21% restocking fee is applicable....

    Trading standards, Cititzens Advice , PayPal disputes and section 75 will all have to support this BS claim first....

    And when my solution of posting in the foam is rejected when they finally reply to my email....we will see the true nature of this rip off merchant....

    Sorry M'Lud I assumed it had been established that you don't need to return in its original packaging but anyway here it is:

    "You don't have to return the item in its original packaging, but you do need to make sure it’s packaged in a way that means it doesn’t get damaged."

    You may well succeed with one of those, but the fact is that in legal terms you agreed to return the product that was supplied to you but you did not.
    You returned it incomplete, and I can pretty much guarantee that nothing in law defines how much a piece of foam detracts from the value of the product. So in my opinion your interests would be best served by phoning them and asking what they can do to help you out.

    I would read the citizens advice link posted...then maybe edit your post....
    Their fee could represent the god almighty for I care...I’ll take them to the small claims court over this...
    This isn’t matter of soaking it up....I’ll seek legal advice if I have to....

    A PayPal dispute will be imminent come Monday if they don’t see reason....I’ll happily pay a restocking fee that doesn’t take the mick....but 21% is total BS

    Thanks - I don't think the link you provided explicitly stated this.
    In theoretical terms it's an interesting interpretation - for example with some items the packaging has a resale value of its own, which does make me wonder if I could make a living out of buying expensive consumer items, sending them back under consumer law, less packaging, and then selling the packaging on Ebay!
    I would be interested to hear what, for example, Trading Standards would actually do in a case like this. Perhaps we will find out, eventually.
