Make sure you get a receipt and send that to CCBC to make sure the CCJ does not get onto the Credit Report. Then start looking at the NEWBIE sticky for "set-aside"2

Also do a Poirot to determine why she did not receive the claim form from the CCBC in Northampton , because it is crucial to getting any set aside granted
That court claim pack is highly likely to have been posted by the CCBC , even if it's to the wrong address , hence it's crucial to any set aside application
The court claim already has a judgment , as shown in picture 12 -
She just made the payment due in full via the DCBLegal website, Sshe didnt manage to get a receipt. Once the payment was made the page refreshed and didnt give her time to take a screenshot. I've asked her to contact them to try to get a copy of the receipt. Contact them and tell them that payemnt was made 04.01.2020 at X timand you require them to confirm to the court AND to you that the CCJ has been settled in full and within deadline.
If you werent living a tthe address, then I guess the claim form was just lost or misplaced.
But Dates dates dates. Dates are critical for your set aside. Construct a SIMPLE TIMELINE showing when
- contravention
- ntk issued
- claim issued (CCBC WILL TELL YOU THIS WHEN YOU RING THEM TOMORROW)
- judgemnt (we know this)
CPR13.2 relies on this info
CPR13.3 will be satisfied with your explanation of going to old address and not all post either received or forwarded to you (you have no idea which, so dont guess or make a statement mroe definite than that) AND your defence.
Also, to be precise: it wasnt just you "not being clear" - you answered a very specific question without ever having seen the document. You made an assumption. That has cost you time and, depending on how the court views any deadlines, may have cost the CCJ already being recorded.
If it has already been recorded then you must do a set aside. Not for the money, but for the CCJ being wiped.2 -
OMG, you (or the D) knew letters were going to an old address in 2019 and the recipient didn't think that was a bit risky with a court claim pending? Could have told them to erase that address to stop a court claim being missed, a year ago. Entirely avoidable and will now cost £255 to apply (no guarantee) to set aside, unless she qualifies for help with court fees (Google it).
