Also try to cut out waffle , save the story for your WS where the word I is also used , stick to bare facts to set the scene and include anything relevant like the law , the CoP and any legal precedents etc
Your WS is where you expand on the defence , the defence opens the TARDIS door , the WS goes through the door into the TARDIS , that time is the time to tell your story , which could be this summer or later1 -
Yes, change the language to the third person, to match the rest of the defence. At no point do you see ''I, my or me'' in the template!
Remove #5, as that is pointless. Who cares if other cars did or didn't get a PCN. Quite often cars parked nearby are decoy cars placed there by the PPC to entice people to think the car park is being used and with no permits or anything.

Imho, a SAR will get you all personal info, but you can also request disclosure of other relevant non-personal info; it is your right to see all the info they hold (other than 'priviliged', that is.)I would do both.1

Thank you and poor attention to detail on my part! I had hoped that #5 would help our defence as I fail to understand why one vehicle gets PCN and not the other? I do have a letter from DVLA confirming that they have never received a request for personal info on the owner of the other vehicle pictured. Will this be totally disregarded in your experience? The DVLA do not keep a database of "owners" but you might mean Registered Keeper. Is it your vehicle pictured? Is it the one about which the PCN has been issued?Brenda_Mayers said:

@Le_Kirk - in the photograph provided by Ardpark which shows my vehicle being parked for 25 mins (which received the PCN), there is a vehicle next to mine in the photo which is a car owned by a family member. They obtained a letter from DVLA as the registered keeper of that car which confirms that the DVLA have never received a request from a TP to release their details. Is this of no relevance to my case? I feel out of my depth with all this!!0

Have you received a claim form from Northampton CCBC in your name as registered keeper of the car to which the claim form relates? Are you the RK of that vehicle? If so, that is what you must deal with. I think it is irrelevant that other car(s) were in the photo and just happens to belong to a family member. Why are you involved with the other vehicle? Did the RK of that vehicle also receive a PCN and is now involved in a small claims court case?2

Yes we have received claim form from Northampton CCBC as the driver of the vehicle (RK was my mother in law so she replied with our details as the driver when the first notice came through). The other vehicle never got a pcn which was parked for the same duration and we thought there may be an argument for unfair and inconsistent charging which is why the owner of the other vehicle got proof to see if that would help us.0

Then I think you continue with your defence as driver. That was stupid, but vey common, and that's why the PPC scammer didn't have cause to approach the DVLA. No idea why you asked them, of course the PPC couldn't get keeper data when the driver has already handed them their name and address and admitted to driving, handing them everything they needed on a plate.PRIVATE 'PCN'?
