STILL REQUEST A SAR AFTER CCBC ISSUED?

Desperately trying to get my head round all the helpful info on here but also worried that I don't have the brains to deal with this well as getting quite confused by it all! Having read the info on newbies, I wanted to ask if I should still request a SAR even though I have now received the CCBC? Date of issue of CCBC was 17 Dec 2020, AoS 22 Dec 2020 Claimant ArdPark Ltd and solicitor is BW Legal. Now trying to prepare my defence but wasnt sure if I should still make reference to the Beavis case as I think someone said on one post this isn't really relevant anymore? Is there any other info you need in order to advise please? Thank you

Send the SAR asap. This will flush out everything the scammers have relating to you.
You will need to include a copy of your V5C, ot the LBA/LBC, or two redact utility/bank/card statements as proof of ID. Never send photo' ID.
Use the template defence in the sticky threads. Only change paragraphs 2 and 3, (and please only post those here).
The Beavis case is nearly always relevant, especially if the scammers have added any fake add-on amounts, usually around £60.
Get pics of the site and signage asap as well as complaining to the landowner and your MP.

it may be relevant , depends on the casestart with the template defence by coupon mad and adapt paragraphs 2 & 3yes email a SAR to the DPO at Ardpark asap, and attach a copy of the claim form as proof of I D under the GDPR DPA lawits never too late for a SAR request, its also foolish not to !!put the total claimed because its likely they added the unlawful £60 or £70 debt collection fee, a typical claim for one pcn is say £200 alll in4

Plenty of time to produce a Defence, but please don't leave it to the last minute. To create a Defence, and then file a Defence by email, look at the second post in the NEWBIES thread.Don't miss the deadline for filing a Defence.3

As a matter of interest can you post the date that ARDPark obtained your details from the DVLA (assuming they did) as they are no longer named in the IPC AoS list.4

You need to provide the registered keeper's full name and address, the address on the V5C logbook and the Vehicle Registration Mark of the vehicle involved in the parking incident.SubjectAccess.Requests@dvla.gov.ukThis service is free of charge.Even though you email your request, the DVLA will respond via Royal Mail. Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

Hi, the date of the 'unauthorised' parking was on 09/02/19 and they wrote to us on 18/02/19 so it must have between those dates. I assume they were still named on the IPC list at that time since the DVLA provided them with my details. Thanks1505grandad said:As a matter of interest can you post the date that ARDPark obtained your details from the DVLA (assuming they did) as they are no longer named in the IPC AoS list.1 -
There are some assumptions there.Brenda_Mayers said:

1) had they perhaps retained information from a previous parking event and therefore didn't need to go to the DVLA again?
2) did they perhaps ask some other accredited operator to get keeper details for them?
Of course neither of those things are allowed, but that does not mean they didn't happen.
I would suggest that you follow @Umkomaas's advice and ask the DVLA who asked for the Keeper details for vehicle AB12XYZ during the month of February 2019.5 -
@KeithP I am still awaiting a reply from the DVLA to confirm which organisation requested my details but have received a reply from the claimant following my SAR request. I am now preparing my defence but upon reading other threads, some people have mentioned that there is a compulsory code of practise about grace periods of parking. Can you tell me if that applies to my situation please? I parked in a space which I believed was part of a sports centre I was visiting for an organsied football match and I stayed for a max of 25 mins. I then received a PPN via the post as I was actually in a parking bay owned by a care home and since I hadn't entered my reg number on the tablet which was inside the care home, I got a ticket. One part of my defence is the insufficient signage particularly as the access to the sports centre is shared with the care home and there is nothing to make it clear that I was on the land of the care home. Can you please advise of this code of practise applies and if I can use it in my defence? Thanks0

If Aardpark were IPC AOS members then they had to comply with the IPC CoP in force at the time of the incident , so download it , read it and apply any relevant facts in your defence
Either way , get on with doing your Defence and post the adapted paragraphs 2 & 3 below for critique2 -
Defences are written in the third person, so change all your "I" to "the Defendant."2
