This has taken up 3 weeks of actual time, and you know, because youve read the set aside threadsa by now, that you have ot act promptly.
You need to get that applicaiton in tomorrow, I would suggest. Otherwise you kiss good bye to CPR13.33 -
Yes to everything you have said except that you have to act promptly and as this isn't going to cost you anything you may as well crack on with the N244, but not like this:I then apply for the N244 using a template and stating that I am not the registered keeper and attaching the evidence that I bought a parking voucher?Nope. That is not what you N244 and WS are about.

I'm still waiting for the paperwork from the court. I rang three weeks ago and asked for it. They sent me info on how to fill out the N244 and a screenshot of the case overview. It doesn't even have a date of when the court case happened. I've emailed them again and will ring tomorrow.0

Could I do it like henrik777 does here:

And for the date just write that I am still waiting to recieve the paperwork from the court?

No court case happened. You really are not understanding a CCJ. It's automatic if people don't defend. There was no hearing.Scribeok said:I'm still waiting for the paperwork from the court. Sorry, I do know that, but surely I was supposed to recieve paperwork from the court to inform me that HX parking had applied for a CCJ and to give me the opportunity to defend it?0
-
They did, it is called a N1 claim form. If you didn't receive it, could it be that you failed to update your V5C with the DVLA. If you were never served with the claim form (but surely you had warning from letter before/of claim) that is a good reason (one of many) for having the CCJ set aside.Scribeok said:Sorry, I do know that, but surely I was supposed to receive paperwork from the court to inform me that HX parking had applied for a CCJ and to give me the opportunity to defend it?3 -
I didn't recieve it. I checked with the CCBC and they said they sent 2 letters. I asked them to resend. They sent me information on the N244 and a screenshot that looks like this: (example taken from other thread)
THE DRIVER OF THE VEHICLE WITH REGISTRATION XXXX (THE 'VEHICLE') PARKED IN BREACH OF THE TERMS OF PARKING STIPULATED ON THE SIGNAGE (THE 'CONTRACT') AT XXXX, ON 02/2018, 02/2018, 02/2018, THUS INCURRING THE PARKING CHARGES (THE 'PCN'S'). THE PCN'S WERE NOT PAID WITHIN 28 DAYS OF ISSUE. THE CLAIMANT CLAIMS THE UNPAID PCN'S FROM THE DEFENDANT ASTHE DRIVER/KEEPER OF THE VEHICLE. DESPITE DEMANDS BEING MADE, THE DEFENDANT HAS FAILED TO SETTLE THEIR OUTSTANDING LIABILITY. THE CLAIMANT CLAIMS £100 PER PCN, £60.00 PER PCN CONTRACTUAL COSTS PURSUANT TO THE CONTRACT AND PCN TERMS AND CONDITIONS, TOGETHER WITH STATUTORY INTEREST OF £65.08 PURSUANT TO S69 OF THE COUNTY COURTS ACT 1984 AT 8.00% PER ANNUM, CONTINUING AT £0.11 PER DAY.

Did they send the originals to the address you were living at before/around the date of your court hearing? Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .
I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

I am not the registered keeper of the car. It is my partners. I don't know how HX parking got my address but I presume they took a punt on me living where the car was registered.
I did check the address with the court and they also had my correct address.
What I am confused about is what to do now.
The example on the thread I read seem to respond to the N1 form. It seems impossible to do without receiving it.
So should I use the template from henrik777 that I have posted above and for dates and information just write that I have not recieved the paperwork and have contacted the court on 15/12/20 but have only recieved a screenshot of the 'particulars of the claim' which does not include this information?
Or do I ring them and ask them for it yet again?0
