SMART PARKING Ignored Appeal - No POPLA code provided

I’m wondering if anyone can help me.  I received a parking fine on the 21/09/2020 - which occurred on the 02/09/2020 by Smart Parking. I sent my appeal the day the fine was issued (21/09/2020) - waited 35 days for a response and nothing - which I then have received numerous letters from Debt Recovery Plus (I assumed the parking fine was dealt with until then)  . So I then sent my appeal again on the 02/12/2020 as I was awaiting a response - the company have now gotten back to me saying it’s too late to appeal and I now need to take it up with Debt Recovery Plus - they haven’t provided any POPLA code. What would you suggest my next steps to be ? Should I write a complaint to the BPA ? Thank you

    I would , because this is typical of Smart Parking , especially around that time , so the BPA are fully aware of it , especially Steve C

    The alleged debt always remains with the claimant Smart parking , they cannot pass it on , but can sub contract some work, they cannot sell it on either , the Kadoe DVLA contract does not allow it to be sold on

    Plan A is your best option though !! Landowner complaint , as the Newbies FAQ sticky thread near the top of the forum tells you

    Plan A trumps plans B & C every time
  • DRP are a DCA and can't hit you with a MCOL claim unless they have been assigned the debt by Smart Parking: if this assignment has not been done, then only Smart Parking can do the court thing.

    Also, which location was the PCN issued for? Btw, it's not a "fine", it's a "speculative invoice", aka PCN, so please remove the f word from your vocabulary (even the mainstream media is guilty of this).
  • The location was the Airport Pub - Manchester. So you guys are saying to complain to the landowner before going to the BPA ? I will let you guys know if I’m successful with this , thank you !

    Have you complaoned yo your MP?   Read what Pete Wishart MP said recently in the House of commons about Smart Parking.

    "I am sick and tired of receiving emails from people complaining about the behaviour of parking companies, telling me that they will never again visit Perth city centre because of the negative experience they had when they had the misfortune to end up in a car park operated by one of these companies. I have received more complaints about one car park in the city of Perth than about any other issue. That car park is operated by the lone ranger of the parking cowboys: the hated and appalling Smart Parking—I see that many other Members are unfortunate enough to have Smart Parking operating in their constituencies. It has reached the stage where one member of my staff now spends a good part of each day just helping my constituents and visitors to my constituency to navigate the appeals process.


    The BPA does not have the ability to regulate these companies and has shown no sign whatsoever that it is trying to get on top of some of the sharper practices. The BPA gives a veneer of legitimacy to some of the more outlandish rogue operators by including them in their membership, allowing them to continue to operate. The Bill will oblige operators such as Smart Parking to amend their practices.


    You never know how far you can go until you go too far.

  • Yes , complain to the CEO of Robinsons brewery , like someone else on here did not long ago and they received a cancellation  by going to the top !!

    Also complain to Steve C at the BPA about Smart and their atrocious appeal system which was big news recently too , he knows all about it !

    And your local MP could be helpful as well

    Get on the offensive asap

    Redx is far too kind about the BPA.
    Smart Parking have been rogue traders for a long time but the BPA fail completely to address this.

    The BPA website give a false impression that they are working for fairness for the motorist.
    In reality, it's FAKE NEWS  and Steve C knows it

    Steve C, why do you allow such scammers membership to your club.  You fail day by day.

    But a serious question to Steve C and all BPA staff.     How happy are you when on xmas day your loved ones open their presents and smile. Are you going to tell them how you could afford them ?
    Will you tell them all about the scammers the BPA take money from and the BPA are too scared to get rid of them.

  • Hey everyone, this was the reply I got from the airport pub.  

    Thank you for your letter regarding your recent visit to The Airport Pub, Ringway Road.

    We are sorry that you are disappointed that you have received a parking fine after your visit to our pub.

    We have extensive signage around the outside of our pub that goes above the legal requirements and have a short waiting time before this is issued.  As you are aware, the Airport itself charges £3 for 5 minutes and £4 for 10 minutes, going over 10 minutes is not permitted.  

    All around us there are parking charges in operation, we know that we charge the lowest amount and, as it is not our intention to exploit our customers’ we have priced our menu to reflect these charges.

    Given the position of the Pub and its potential impact on local and Airport security, the Police Authority insist that we install Smart Parking to ensure that we maintain the flow and control of vehicles on the carpark  

    As our pub is very popular, especially with the garden looking straight onto the runway, it is imperative that we have amble parking for customers wanting to eat and drink, often queuing to get into the carpark, with waiting cars often hindering our customers’ being able to park safely.  

    As you have indicated, you have appealed with Smart Parking, the other course of action you can take is to appeal to Popla, the independent appeals body

    They ignored all the points I was saying ( don’t know why they mentioned going over by 10 minutes as this isn’t even relevant to the case.  They have told me to appeal to popla. Smart parking won’t even issue me a code ?! Does anyone know what action I should take next ?

    Complain to the BPA AOS team about the lack of a Popla code etc , including a brief timeline of events and attaching copies of all paperwork

    It is clear that you failed to read my earlier post properly , meaning I have told you twice now !!
