    Not on its own, no.

    But as part of the standard WS as shown in the NEWBIES thread, with photos showing the signs are illegible and suggest 1 hour free, plus the usual other exhibits suggested for all newbies to use, in that 'sticky' Announcement thread post #2, it will at least give you the basis of a case that you didn't knowingly agree to a contract.

    Have to say it's surprising anyone would leave a car at a petrol station and go off to use other premises in the area. Not OK (that's how it looks, anyway) and the Judge might start with that mindset because petrol stations are not exactly large premises offering free parking for the general population to use for an hour.

  • Yes, it's not OK and I'm guilty for that.
    I will try explain in my WS that it was a misunderstanding it won't happen again.
    I got a letter saying the claimant wishes to proceed to court, will I receive my questionaire soon or will it come with the WS request?

    Read the what happens when post

    You DQ will arrive after the CCBC post it to you , perhaps in January

    The WS plus Exhibits plus summary costs assessment stage is in several months time
  • Thank you will read it now and wait to receive the DQ from the CCBC

    And keep checking mcol so you know when the dq has been sent. 
    That's the significantly more sensible route to take.

    Notice of Allocation to the Small Claims Track (hearing)

    Is there anything I need to do at this stage?

    Read that Notice thoroughly and be sure to understand every word.

    Then refer once again to the NEWBIES thread for further guidance.

    Every single question on process you can think of, is in the newbies thread. 

    Does this give you a hearing date, and if so does it then give you your dealdine for filing and serving documents, such as your WS and exhibits?

    That's the strange thing I can't see a hearing a date or a deadline for filing the serving documents

    I did read the newbies thread but I can see the info in this letter.

    Could be I'm missing it though, would it be possible to show the letter here if I hide any confidential information?

    Yes of course.

    Is there not a paragraph on your Notice of Allocation something like:
    Each party must deliver to every other party and to the court office copies of all documents on which he intends to rely at the hearing no later than [ . . . ] [14 days before the hearing].
    Might be on the back.
    Those documents you intend to rely on are your Witness Statement and evidence.
