I didn’t get the chance to ask for costs. The judge and claimants rep were having a debate around the contract and then in the middle of it, the judge asked if I had anything to add which I said I didn’t (I assumed she meant if I had anything to add about the contract) and then they went back to debating over the contract for another few minutes and then the judge said she’ll be striking out the claim and will not allow an appeal and they both left the conversation. I also wanted to ask what type if at all any correspondence I’d receive about the strike out but it was just me left on the conference call. But I am genuinely not fussed about the costs! I’m just glad for this result. I’m in the middle of a house move and this was the last thing I needed.1

Glad to hear you won - well done!2

Very well done on your win. Any Judge that that woeful contract impresses must need their eyesight tested. It looks to have been drafted by a primary school class!I’m in the middle of a house move and this was the last thing I needed.Just a safety first question on this. Do you have any other private parking tickets (from any PPC) still unresolved, if so, you need to inform the PPC of your new address? Also, don't forget to notify the DVLA of the new address for your driving licence and your V5C - I'm afraid you need to do separate notifications for each.Great stuff, a nice result. Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .
I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

The judge was in disbelief over the so called contract. She called it unlawful. The rep didn’t know what to say and quoted the beavis contract which the judge wasn’t interested in. The rep was very unprepared which was quite surprising. When the judge questioned the contract and who the landowner was, the rep kept trying to change the subject to me the driver automatically entering into a contract by using the car park.I don’t have any other tickets (that I’m aware of). Since driving, I’ve only had the one off a private firm. But thanks for the advice! I plan to sell my car very soon anyway as I work from home and my new office is located in the city centre so the car expenditure is just going to be a waste if I’m not going to be driving as much as I did.3

Hello, hoping you can help me with a quick query. Not opening a new thread as it’s hopefully just one question (sorry if I’m breaking forum rules). I had a hearing scheduled for 26th May and to my surprise have received N279 from DCB Legal in the post today! I have attached a pic. Now I cannot log into MCOL to check the status because it keeps saying my password is wrong and I have tried to reset it several times and long story short, I cant. I even created a new account but it’s not letting me check the status of this claim. I have called the courts to confirm if they have received the N279 and what happens next and they’re not helping and are telling me to wait for contact regarding any changes. with the hearing only 3 working days away, I have sent them an email but it says I will get a response within 10 working days.
the thing is I have another really important appointment on the 26th and was still deciding on whether or not I should attend the hearing or the other appointment. How can I get confirmation that the N279 has been accepted? DCB filed it on the 16th and I haven’t heard anything from the courts yet.I see on the form that a judge has to grant permission to discontinue the claim. Can they decline and what is the likely hood of this happening?0 -
Ring the court. MCOL isn't relevant, it was just an admin gateway at the very start of the claim. It doesn't ever show what's happening once a case is allocated locally.
And congrats - you won your battle!

Got the letter this morning and have ran the court twice since. Really unhelpful. Just kept saying wait for correspondence. Told them hearing in a few days but they said the same thing. Gonna call again MondayDo you think it’s ok for me not to go even if I don’t get any letter from the court saying case has been discontinued?
I thought I had no chance of winning this one as unlike the last time, I was actually at fault. Thought I could get away with not paying as it was late night 😆0 -
Email the court hearings email a copy of the discontinuance and say you consider the hearing vacated and will of course not be attending unless the court tells you otherwise by Tuesday.
Did you see while you were away, that consumers won the war? New statutory Code of Practice announced 7.2.2022 will shake up the whole thing and end the gravy train.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
