Hi, I received a claim form from County Court Business Centre on 27/11/2020. The issue date on the letter however is 23/11/2020. As per the newbies thread, I am going to go online and acknowledge the claim and type up my defence using the template. Any suggestions on what else I can include would be greatly appreciated.
The ticket was issued by Premier Parking Logistics on 07/09/2019. What happened was they had an outside and sort of like an underground car park and i parked underground and the sign said to pay at the ticket machine that was on the outside car park. There was 2 ticket machines outside, one belonging to premier and one to the council. I mistakenly paid at the councils machine and I have a screenshot to prove this as I always take pictures when I pay for parking. I did my business and went back to my car to see the ticket. I asked the ticket guy why he issued me a ticket when I paid and showed him the receipt and he told me I paid at the wrong machine. Was ready to get into an argument about how they should make it clear but he said it’s nothing to do with him and to speak to Premier on the email address provided on the ticket. Anyways I ignored all the debt letters and have now received this claim form. Also reading through the form and the particulars of claim, it says on there “the driver agreed to pay within 28 days but did not”. This is not true. I didn’t agree to anything.
Before I submit the acknowledgement, is there anything I should do.

Read other recent WW PPL threads for a start !! Same advice as in those cases
Do the AOS online , no typing into the defence box , no admitting part of the claim
Email a SAR to the DPO at PPL ASAP , attaching a copy of the claim form as proof of I D under the GDPR law
Start on amending paragraphs 2 & 3 and post them below for critique
Ps , the driver agreed to a parking contract by parking there , if it can be enforced in law is different , so you should especially keep your eye on this WW thread too2 -

Thanks a lot for the advice. I’ve filed the AoS and emailed myself a copy of it as well. Will start working on the defence right away and post on here before submitting.1

I suggest you do it that way, if the MCOL website will still allow it.3 -
I did do it through the MCOL website. When I said I emailed a copy to myself, I meant the PDF document of the acknowledgment. Logged into MCOL now and it’s there.

This sounds exactly the same scenario as mine, possibly the same car park. I’ve filed my AOS, emailed my SAR and am prepping my defence for paragraphs 2 & 3.2

Any SAR demands your own data , nothing else
Most people would use the template SAR linked in the newbies thread , based on the legal beagles template
Copy , paste , email , with proof of I D attached , in this case a copy of the claim form
This is not difficult , it's common sense , data is data , from any company that holds your information0 -
I have emailed the SAR and also emailed the solicitor to advise. I haven’t made any complaints to the restaurant I was visiting the day I got the ticket. I just ignored everything till now. The newbies thread does say to email a complaint to the retailer or owner of the place you were visiting when parking. Will this affect my defence in anyway? It’s been over a year since I got the ticket, is it too late to send an email now?0

Nothing ventured ......!Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .
