Their WS below. It’s 41 pages long and I don’t have access to a scanner atm to upload it all as a single pdf file. And it’s not allowing me to upload images of all pages in one single post. The rest of their WS is about 10 images of my car, 3 signs from the car park and correspondence I’ve had via email where I’ve refused to pay the fine and from when I requested SAR.0 -
That Parking Scheme Agreement is hilarious!
It is between PPL and no-one (the client is not identified in the first paragraph) and it's goobledegook in many places, incoherent and even calls the PSA a 'PSE'. Who is the person who signed for the non-existent client? Are the details under his signature actually black or did you blank the data under his name out?
Can you show us the pics of the sign that they've shown as evidence?PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

I struggle to see how that WS is worded correctly./ He is not making this WS on behalf of anyone, as he has no legal entity.
Agreed on that "PSA" being worthless as a contractual document, as the other party is never identified1 -
I too am fighting a case under the same circumstances for the same car park!0

So that agreement
- does not name one of the two parties, so cannot form an agreement full stop
- there is no indication who that person is, as their name and position att he unknown party are not completed, so it definitely isnt an agreement under either S43 or S44
Make sure you absolutely shoot this as full of holes as it is, in the hearing. Ask them where their evidence of landowner authority is, and if they point to this, lay into it!3 -
Hello! I had my hearing today and I won! 2 key points that the judge repeated was the lack of contract (the judge ripped into the claimants rep about the lack of authority and what gives the claimant the right to try and enforce a parking charge without lawful landowner authority) and the second point was that the machine I paid on was very close by and the claimants machine was no where to be seen so it was a genuine mistake. I think I said about 10 words throughout the 20 minute conversation. The judge also said the signs were too small and gave no clear Indication as to where the claimants machine was. At the end, the claimants rep said they would like to appeal and the judge said she will not be granting permission for an appeal because in her view, the claimants WS has failed to provide reasonable grounds to issue the parking ticket in the first place. I am so relieved!!! Thank you all for your support! Glad I didn’t cave and fought this!!!6
