    Thanks @Coupon-mad and @twhitehousescat, @beamerguy. Not sure if I have understood everyone correctly but I have removed personal details, and save as a pdf which is attached to this post. Hopefully that works for everyone. I have included within the appeal, facts I was aware of at the time I wrote it last weekend. To be clear, this has gone off as my POPLA appeal - response awaited! I'm not sure what comes next, but am investigating that. AS others have said, I also intend to complain to my MP and to BHCC in the next few days.

    OK you might win on signage but it will be pot luck.  You didn't mention 'no landowner authority' which is a shame because the BHCC contract is a joke, but OPS won't have to show it to POPLA.

    For all other newbies reading this, send me a pm if you get a Stanmer Park ticket and DON'T DON'T DON'T appeal as driver.   This is BHCC owned and not relevant land.  Also OPS have been told by the BPA to issue non-POFA NTKs now (since September) which they are, so these are a cinch for a keeper to beat.

    To the OP of this thread - don't despair but expect a fob off from the Council.

    bearing in mind CM  s comments above about claiming POFA NTKs and the fact that your ticket is AFTER september , are One parking claiming they are acting inder the right to make owner liable with POFa 

    just another complaint to the bpa 

    as they say up north , every little nail helps

    The NTK is non-POFA but the OP appealed as driver.

    Many thanks for your comments as at 9.42pm yesterday. (I know its frustrating for all, but I only know what I know, I wouldn't have appealed as driver had I been aware of all the threads on MSE BEFORE I appealed - I only checked MSE after seeing a reference in another arena). Sorry about that! I am happy to help spread the word though!

    So, moving forward, (and just to assist me,) I didn't mention the  'no landowner authority' aspect but I am unsure of teh relevance - will I find that within the newbies page please? (I need to find and understand that). Do we have that contract / what is the issue with it please?

    Also, I wont be paying, but I am unclear what comes next - do I await the threatening letter re courts and say I am looking forward to it, (or does something else happen?)

    It's probably easier if I show you the bones of a POPLA appeal I wrote for someone that talks about the main issues with Stanmer Park, Brighton.  See attached. 

    That one was for an admitted driver so I couldn't argue 'no keeper liability/not relevant land' like we normally would, but it still made OPS throw in the towel.

    I also have the more recent landowner authority documents and they are so badly drafted as to be laughable.  BHCC appear to have no idea what they are doing and are ripe for a complaint to the Ombudsman that I must crack on with for a victim who actually paid OPS.
