    I asked because as Morrisons no longer trade at the car park in question the CEO has no incentive to get involved.

    However, I guess the worse that can happen is the CEO ignores me.

    Does the CEO even know that the store you're talking about is now Closed?

    If you don't tell him, will he, or his office, cancel the ticket anyway?  :)

    Hello everyone,

    Would someone be kind enough to take a look at the email I am about to send to the CEO of Morrisons please. It is a merge of what Coupon-mad has written and what I have already sent to Euro Car Park's solicitors. I removed the request to have my VRM added to their white list as Morrison's no longer trade at the car park in question.

    To Mr David Potts (CEO),

    My name is Mr xxxxx xxxxxx and a stroke survivor.  

    Since 2014 I was a regular customer at your Crawley based supermarket until it sadly closed in late 2019.  I am physically slower than I used to be and would sometimes struggle to exit the car park before the two-hour limit. 

    I recently learned that several PCNs from as far back as 2017 was sent to an incorrect address and as such never appealed.  Now, to my absolute horror, I have been sent a 'letter before claim' threatening to take me to court if I fail to pay the 'debt' of several hundred pounds.

    As Morrison's, were the managers of the Crawley car park at the time the PCNs were issued, Morrison's and Euro Car Park's conduct are 'jointly and severally liable' for indirect discrimination. 

    I have sort legal advice and must inform you that I have contacted the solicitors representing Euro Car Parks Ltd (SCS Law) that as a stroke survivor, I am to cite 'disability discrimination' under the Equality Act 2010.

    "A person who takes longer to shop due to being a stroke survivor is LEGALLY entitled to a 'reasonable adjustment' of more time."  

    Now you are aware of my medical needs and I meet the definition of disability under the Equality Act 2010, can you please contact Euro Car Parks Ltd and tell them to cancel the charges against me.

    Failure to cancel all charges, going forward, the indirect discrimination will be compounded by direct discrimination due to relying upon remote ANPR cameras and signs that made no provision for people with protected medical characteristics by offering any information about how to ask for more time as is their legal right under the Equality Act 2010.  

    I would be eternally grateful if you could help end this awful nightmare as the thought of having to go to court is making me extremely ill.

    I agree with all Fruitcake's points, plus remove the speechmarks here because this is not a quote from the Act:
    "A person who takes longer to shop due to being a stroke survivor is LEGALLY entitled to a 'reasonable adjustment' of more time."  

    The sentence is fine and it is true, but you need to remove the speechmarks from it.

    Also, you must always make a communication timebound: i.e. state not just what you want them to do (cancel the PCNs) but state by when.  Seven days, or by the end of the month at the latest. 

    Then state at the end, that if they did not contract with Euro Car Parks at the Crawley site (i.e. if it was in fact a property agent who held this contract) then they must pass the complaint to that company and tell you who it is, because you will be naming Morrisons as a Defendant in a counterclaim for disability discrimination, if Euro Car Parks continue with this unlawful harassment and sue.

    When using acronyms or initials, always explain what they mean the first time you use them, and then just the initials from then on. 
    So, Parking Charge Notice (PCN) the first time, then PCN afterwards.

    Sought help, not sort.

    I would remove the word "conduct" from this sentence.

    Small update:

    Received a reply from Morrison's customer services thanking me for contacting the CEO with my parking issue and they 'are looking into this' and will 'contact me shortly with their findings'.

    Not holding my breath but didn't even expect a reply so you never know.

  • Hello everyone,

    I've just received a response from the DPO of Euro Car Parks Ltd regarding my SAR to them.
    They are treating the request as an Article 15 under the General Data Protection Regulation (GDPR) 2018 and as such are asking me to provide evidence of proof of ownership for my vehicle (for example a copy or image of a VO5 document).

    I'm assuming this is correct and is safe to email them a scan of my VO5 to them?

    VO5 is a shampoo ;) ... you mean V5C :)
    And yes, that's a reasonable request for proof of ID as it identifies both yourself and the vehicle. If they come back asking for ever more forms of ID then you raise a complaint with ICO as they have no valid reason for further forms of ID.
  • Oh and my local MP has also just confirmed he will be happy to contact Euro Car Parks on my behalf.
