I will take a better photo tomorrow but I believe it says pay within 15 minutes. I was there for just over an hour, from what I can remember I paid for the first hour and then paid for an additional before leaving after just going over the hour limit.Coupon-mad said:Where's the term about paying within x minutes?
Thanks for your advice.1 -
Thanks for your help. I will send off the AoS tomorrow. I have read through the defence templates but I'm a bit unsure as to which facts apply to this case and which to include.KeithP said:Devonisheaven11 said:The claim form is dated 10th November so I wont send off the Aos until after the 15th.With a Claim Issue Date of 10th November, you have until Monday 30th November to file an Acknowledgment of Service, but there is nothing to be gained by delaying it. Those are the facts as well as that you did not see any mention of £100 on the tariff list at the machine and did not knowingly accept being punished for 'paying late'. Given that parking charges cannot be purely to punish drivers and must have a legitimate interest, this claim fails and is fully distinguished from the commercial interest that saved the parking charge in ParkingEye v Beavis from breaching the penalty rule; a doctrine which the Supreme Court held begins as 'engaged' in all such cases.Devonisheaven11 said:I was there for just over an hour, from what I can remember I paid for the first hour and then paid for an additional before leaving after just going over the hour limit.PRIVATE 'PCN'? When you say "send off" what do you mean? Surely you are submitting the AoS on-line! In another post you mentoned "getting a better photo"; if you have to get a better photo does that mean the signs are not good enough to be read by the driver?Devonisheaven11 said:Thanks for your help. Here is an example of the same sign, that actual one is right next to the ticket machine so is readable. Thanks for your help, I'm just not familiar with what will hold up as a defence. I can technically read it so don't know if I can still use the poor signage defence.

So that sign appears to be at ankle height?PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
