Surely an electronic copy is much more flexible for you. For instance if you want (or are asked) to show certain parts of it for forum input?
Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

Probably - I'm more annoyed at the fact they were late providing it and that I haven't even got the electronic copy. I checked the source email and they didn't attach in the first place - it wasn't blocked.

Haha - and it was late, too.

Obviously that will be on your crib sheet for the hearing as the first preliminary matter = failure to follow the Court Order and deadlines.

I'm not sure what to do next - I called the court who suggested emailing the Judge to inform them the WS hadn't been received on time, which I did yesterday morning. DCB then "tried" to email the WS through - I responded straight away to say it wasn't attached, but I've not heard anything since. I'm not sure whether to just wait (but I'm worried I won't get anything through at all, or not until the last minute), to respond to DCB again (possibly copy in the court email address and explain I want to make sure it's on record), or to contact the court again in a couple of days to say I've still not received.

They said they also served a copy to the court - but if they also did this by email - maybe they didn't get the attachment either....

maybe its too large an attachment for one email ? I know that Johnnersh said he split one recently into 3 attachments over 3 emails to ensure it got through , different email providers have different attachment limits , both for sending and for receiving

as you have already informed the court and dcb legal there is little you can do , their incompetence is their problem, just ensure you are above reproach
  • Have PROOF of them
    - being late
    - still failing to actually attach

so you can show the court.
As stated, it's a breach of the order. Wha ties the ORDER say happens if docs are not served in time? Anything?  You know, we don't.

Finally have the witness statement. It seems very basic compared to others I've seen, with very little evidence. (does this mean I need to expect a supplementary WS once they've read mine?)
They point out copy and paste in the defence, but then talk about the land being a shopping centre on  page 6 (xvii) when it is an airport! (not the only one copying and pasting I guess!!)
They have also included the contract with the airport, which is good, as the images support my case for the vehicle being outside the enforcement area. The photographs they've included on pages 23-26 are even of Bristol airport from what I can tell.
They didn't address point about bylaws in my defence (continued into my WS) or given a proper explanation on the RTA.
I'm going to go through it in more detail (for what there is), but would welcome any other support :)

Just an update - a quick google streetview check - the photos are from Bristol airport - but nowhere near the area in question!

Your redactions seem to have slipped on page 40 of that WS.

Page 44 shows a letter from you which is marked "Without Prejudice".

Sounds good.  Your appeal made me laugh!

Someone won a VCS case the other day about an Airport no-stopping zone.  See if you can find it.
