VCS No Stopping at Bristol Airport - Witness Statement

Morning all,

I've got a court date for a no stopping PCN issued by VCS and have been looking through various related witness statements and other cases. WS needs to be submitted by 16th November.

I've noticed that some include a detailed run through of the day of the alleged offence, but others don't - is it worth including? E.g. vehicle was here, it was stationary for 11 seconds, but not parked etc.

Also - should I include my own pictures of the signs? I've got a couple from other people, but they are taken from a distance so don't show any detail.

    If you have read through other witness statements you will note that they are all "in support of my defence as already filed" and are a narrative of what happened on the day and subsequently.  You would include pictures that show how bad the signs are or how badly positioned they are.  You might want to include a definition of "parking" (seen one on the forum quoted in a judgment) that you put it in a designated, marked out place, turn off the engine get out of the car, lock it and walk away.  However, sitting in the car is still parking; driving round a car park looking for a space is not parking.  You seem to have fallen foul of the "no stopping" issue and there are quite a few cases on the forum particularly at airports.  Search for them.

    As above , read every VCS no stopping threads for all VCS infested airports , , Bristol , RHA Doncaster , EMA , Southend , JLA Liverpool etc , same stories , same parking company , all airports , extremely common

    You also need to be aware of the VCS v Ward appeal case just in case it is prayed in aid against you. It was a dreadful decision.  It's not to say you're painted into any corner by this - just last month VCS lost a 'stopping' case in court and never offered the Ward judgment to aid their case.  Just a heads up, read it, understand it and be ready for it if they put it into their WS.

    If they are about the same issue @N0tme you should ask a board guide (send a message to @soolin or @savvy) and ask one of them to merge your threads.  Having two threads open about the same issue leads to confusion.

    That's interesting - Not sure if it makes any difference, but the alleged offence took place outside of the coloured lines in the images on page 19 and 21 of the contract (in the box in the diagram below)

    If the alleged event occurred outside the area they have a contract to scam, they had no reason to obtain and process keeper data from the DVLA, and the DVLA had no reason to release the data. 
    Complaints should be made to the landowner, the IPC, the DVLA, and your MP with proof the vehicle was outside the area that scammers had a contract to scam.
    The DVLA complaint should be twofold. One that the scammers requested and process the keeper's personal data without reason, and the other that the DVLA released the data without checking the request from the scammer was valid.
    This is also a DVLA KADOE contract breach so complaints should be made to the KADOE team as well.

    Complain email addresses for the DVLA are ccrt@dvla.gov.uk and KADOEservice.support@dvla.gov.uk

    Your proof above should ideally include the scammer's own evidence such as a combination of photos and the site plan.

    Great - I'll fire off the complaints and make sure it's clear in my WS - hoping to upload a copy as soon as I'm happy with the draft.
    Question on the exhibits for the WS - where I reference just a single paragraph or small part of a document, should I still include the whole document as an exhibit, or is it OK to just include relevant pages?
