3 month old PC sent back for repair now lost

To make it clear i would be sending an LBA in the future 3 to 4 weeks time frame .Business yes very relevant as consumer laws are not for business , and you do ask about Consumer Rights .< This is a 3 month old PC that is clearly unfit for purpose>Might be or could be user damage that's why they have the right to inspect .<I am asking what rights I have if they cannot find my PC and how long I should be expected to wait for them to do so. I really didn't think it would be this hard to get an answer.>AS said about 28 days but the law does not say xx days . this is a forum and its users opinions .The fact that the courier has lost it ?? does complicate matters .2

I don't know what your personal grievance is KatrinaWaves but I'd really rather you'd vented it elsewhere today to be honest.
With respect, all you've actually offered in answer my question is tell me it's too early to do anything now. I even told you I appreciated your comment. But I didn't ask what to do right now. I asked what rights I have if this company continues this pattern of messing things up, what I can do if the PC is not found, how long I must legally expect to wait for them to perform the repair before pursuing further action and what action to take. But you seem to have taken this as if I am gearing up to threaten court action because my PC has "only been lost for 4 days".
I wonder how you would react if your personal property worth over £1000 had been lost for 4 days with no solid sign that anyone was doing anything about finding it and the only means to investigating where it has gone - the company who arranged to collect it in the first place - is about as communicative and helpful so far as bowl of rotten bananas. And that's even before you include the fact that this property is only 3 months old and unfit for purpose.
But this is clearly not the place to find answers, only arguments. I shall endeavour to spend my time more wisely in future.0 -

You are clearly in a tizz and wanting things done ‘urgently’ due to lockdown (which is tomorow) and want to know if you can demand a refund or replacement if you’re not happy with how long it’s going to take (which you are clearly stating multiple times you are not happy with)
So maybe you think you posted a ‘how long do I wait until taking further action about my PC that is in for repair but is currently MIA for 4 weeks’ but what you actually wrote wasn’t quite as sensible was it...2 -

My previous laptop (bought in Jan 2013) was from CyberPower UK. I never had any issues fortunately so can't comment on their after sales care (other than I had a couple of tech support questions that were answered quickly and effectively). They're based in the Team Valley Trading Estate just off the A1M near Gateshead.
Your legal position is that you must give them the opportunity to a) confirm whether or not it is lost, and b) time to effect a repair (or some other remedy, such as refund or replace). I would say 30 days from collection is a reasonable time frame ... if they're unable to achieve that then you have a sound basis from which to take this further. (If it's lost then they can choose to replace or refund. Any refund must be in full as it is less than 6 months since purchase).

As you are a sole trader and use the laptop as a tool of your business then this is not a consumer purchase but a B2B purchase, therefore you have no consumer rights and instead have to rely on aspect of SoGA and contract law. It's irrelevant that you also use it for personal use.
I understand why you are frustrated with the being messed around with collection and now the possibility that it has gone missing however you need to be patient. It is far too early to be demanding anything or considering an LBA. If they have lost it then it is reasonable for that to be investigated before they even consider a refund or replacement. If they haven't lost it, it will arrive in the next few days and they can carry out the inspection and repair.
You clearly have access to another device as you said you were mid lesson when DPD arrived, it is also sensible if you need a computer to run your business to have a backup plan in place in case your main one fails.0
