3 month old PC sent back for repair now lost

  • This is not an estimate of my own. It has taken 2 weeks to get the PC collected and sent to them. They quoted 10 working days from receiving the PC to getting it back to me. It has not yet been received by them. 4 weeks is the absolute minimum this whole process will take.

    As for any consumer rights, you do say that you teach at home and cannot be without a pc for 4 weeks. I am sorry, but if you run a business, then business continuity must be part of your risk. Due diligence when purchasing business equipment. These are not consumer rights issues, but as you possibly purchased not as a business, then you will not get any same day service.

    The company I work part time for has a same day service with their provider, and when one of our office workers pc failed, the replacement was on our site in two hours!
    I didn't say I couldn't be without a PC. I wouldn't say I run a business, I'm just one self employed person with a few students. I didn't purchase the PC solely for the purpose of using it for teaching. I'm not expecting business priority, I'm just asking what rights I have as a person who has bought a PC that was clearly not fit for purpose.
    Then you have the service you have paid for. Although I do not know what you teach, but if you teach somebody to do a job, which could injure or harm them, then you are liable to their work. Business or not, if you have not considered this, then you are then liable.

    OK so what do you now want to do ?? .
    CR says reasonable time   lets say 28 days  with current Covid double that .
    But if you are getting paid for work then its a Business to Business transaction defined by the contract terms .
    Any next step would to see if they would replace or part refund  otherwise you go down the court route .
    Personally i would fire off an LBA letter before action and see if i could shift them on the refuns/ replace .

    It seems like my mentioning my business has been misleading so I apologise. I am not asking for business advice or expecting a company to jump to it because it is impacting my business. What I do with my students and what I teach has absolutely no bearing on this matter or in this discussion. It has nothing to do with my business. I can continue my business without interruption regardless of the PC. I only mentioned that it would be really very useful to have it back and that I am concerned about the fact that it is lost. I now regret even mentioning the word teaching.
    I am asking about my personal consumer rights. I don't think I am getting the service I have paid for. This is a 3 month old PC that is clearly unfit for purpose and the company have not only taken twice as long as they quoted to do the repair but the PC itself is currently lost. 
    I am asking what rights I have if they cannot find my PC and how long I should be expected to wait for them to do so. I really didn't think it would be this hard to get an answer.

    I'll keep chasing and hope it doesn't come to that obviously. I can see a few templates for LBA letters online, are there any you would particularly recommend?

    I will leave it as that. Though if you professionally teach somebody, let’s say ballet, and they suffer an injury because of what you taught them, you obviously understand that you are then liable for their injury. Not the consumer, sorry business, information you want to hear. But then again, I am I do not run a business.

    I think you’ve misread drastically. JJ hasn’t said anything new. In fact he’s saying 2 months is acceptable, yet they’re ‘answering your question?’

    firing off a LBA after 4 days of it being collected will get you at best precisely nowhere and at worst, pushed to the back of the queue. 
    My original questions were:
    How long am I supposed to wait around for DPD to find the parcel and what happens if they can't? What if it's been damaged?  Am I within my rights to demand a refund or replacement if I'm not happy with the repair or how long it's going to take?
    From what I can see, JJ at least attempted to answer my first question and made a suggestion about the third. Not sure why you feel the need to request an explanation but there you are.

    Which is exactly what I and other people told you, if the repair fails you can request another remedy, and 4 days is too early to do anything.

    I guess you just needed it fluffier and with a legal threat at the end, which won’t help.
