Why not tell us (as I've already asked) what type of car park is it (and it's name), because for certain sites, there are strategies that work without any necessity for appeals.
My apologies - I forgot to reply to this. It’s an open car park on Matilda street, Sheffield.
I've found one other thread about Matilda Street car park in Sheffield. There are two there, one is council operated, the other ECP territory. Did you inadvertently pay for the wrong car park via your app as the poster in the following thread did?  It doesn't really help you, other than it might make it clearer as to why they've issued the charge.

Nooooo! I have done this. Just looked through the map and clicked on the wrong one ( new phone issues) . I have to pay this now. Now that I have put the appeal through, can I just go and pay it via the website? Or do I have to wait till the verdict?

    Thanks

Personally I would wait for the verdict , checking if that ntk was POFA compliant or not in the meantime

It could also be classed as a major keying error so check what the BPA CoP says about that , a £20 charge , not £60
  • Thank you Reed.
You are right I can be £20. Let’s see what the verdict comes back as.

    Thank you all.

If they issue a popla code or the £60 , reply with the relevant clause stating that it was a major keying error and offering £20 , or you will complain about it to the BPA AOS team

Bear in mind ECP have no idea what happened at this time

You still have not told us if the NTK PCN complied with POFA (if it was a postal notice , not a windscreen PCN)

So the wording on it needs to be pedantically checked against the requirements of the Protection of Freedoms Act 2012 (Schedule 4), especially, but not limited to para 9.

Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

Just read through my letter - looks like it complies with POFA.
  • If I wait till the verdict will my charges increase in any form? Or will it still be max £100? And if they take the BPA clause is agreed - it comes down to £20 is this correct?

Yes it probably does.  You do realise you don't ''have to pay'' though...and could see this through to appeal, then court, and NO CCJ IS RISKED AT ALL?

As we have seen this at least twice on this forum, is it that the name of the car park on the app looks far too similar?  I would also complain to the app provider and state that this has happened to more than one person, and ask what can be done to make the car park providers clearer.

Can you show us a screenshot of what the two car park names look like on the app?
