I have put this towards an appeal via the website, hoping to ring them up on Monday too.

What ever you do don't do that, you won't get anywhere, they won't be interested (except to confirm you are hooked for more pressure) and you may drop yourself in it further!

Ah okay - thanks for the heads up. I will not be doing this.
  • Hi,
Thank you all - how long do they take to respond to appeals? When I submitted my appeal to them yesterday it said it can take up to 35 days! I am half tempted to just pay it off and get it over with. Don’t want this adding into the stress that I already have. If in the case I decide to pay it off before the appeal verdict comes through - would there be some sort of problem? I didn’t know there was the 5 minute rule, or I would have immediately paid on the app. Ideally don’t want to loose £100 if things don’t go my way.

    Thanks
    J

Write or email the landowner or retailer or managing agent for the site , do not phone anyone !! Nobody !
A landowner , retailer or managing agent cancellation is best , no question about it !! Especially if it was Morrisons

Appeal as keeper using the blue text template on the ECP website , no blabbing about who was driving

ECP do not commit fraud so be careful what you say on public forums , no malicious falsehoods or defamation

Do not ignore either , it is foolish to ignore

Only a CCJ can affect your credit rating , which only happens if you fail to pay a court judgment in good time , so contempt of court really , so if you lost in court , pay up , in full , promptly !! No matter what the core reason for it happening in the first place

The default daily tariff is £100 , the PCN and signage say so , the £60 is a notional figure , a discount only allowed for paying up quickly and not making a fuss. It's not a £60 charge , it's a £100 charge discounted by 40% for early payment

    If you buy a £100 watch for £60 due to a black Friday discount of 40% , it's still a £100 watch !!

No good trying to buy it for £60 a week later after the discount has ended !

Also - will not paying affect my credit score in anyway? Either by POPLA or ECP.
So you understand .......  parking companies, POPLA, debt collectors and dodgy legals DO NOT have such powers on your credit rating.
There is only one person who can inact a CCJ and that is a judge and that vanishes if you paid within the period given by the judge.  That only happens if you lose but with the help of this forum, if it gets as far as court, you will probably win

Why not tell us (as I've already asked) what type of car park is it (and it's name), because for certain sites, there are strategies that work without any necessity for appeals.
Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

My apologies - I forgot to reply to this. It’s an open car park on Matilda street, Sheffield.

I've found one other thread about Matilda Street car park in Sheffield. There are two there, one is council operated, the other ECP territory. Did you inadvertently pay for the wrong car park via your app as the poster in the following thread did?  It doesn't really help you, other than it might make it clearer as to why they've issued the charge.

Bear in mind that the BPA CoP clause 13 says the 5 minutes is a minimum period , so not set in stone !!

Arguing reasons why it took longer are perfectly valid reasons , for an occupant of the vehicle

So the first task is plan A

The concurrent task is to check if the NTK PCN is POFA compliant , or not !!

If it is , then no point in hiding the drivers details , POFA protects keepers , not driver's

Then it's plan B , the appeal to ECP

Then it's plan C , the Popla appeal

..... and there is one technical argument already; if you did indeed pay for the wrong car park, the signs were clearly faulty with no clear demarcation marking between the two differently owned car parks.
