Default CCJ filed against me and Court Letters sent to wrong address

  • I thought I would update you guys on what has happened so far:
    - Yesterday, I sent my N244 form with my Witness Statement and Draft Order to the CCBC and paid my £255.
    - I got an email today to say that my case has been sent to my local court.
    - I'm not sure if anyone else had this problem but the court person said to email all of my evidence documents as a PDF only because she could not print them all out. So today I'm converting everything I have to a PDF and re-sending them.
    I just want to thank everyone who has helped me till this point but I know there's more to do.
    Will keep you guys updated.
    P.S. Do I start constructing my defence right now or wait till the court gives me the dates for submission?

    No harm in having it ready but you need to have the ccj set aside first (which may require a contested hearing) before you need to file a defence. That process is likely to take several weeks.

    You should have the easy draft defence already. It's in the newbies thread. 
  • Also, I'm a bit confused. I have 9 PCNs against my name however the Claimant only took 4 PCNs to court and thus the CCJ. The letter before claim was for all 9 PCNs as well.
    So can the claimant pick and choose the amount of PCNs to be taken to court? I mean if the LBC was for 9 PCNs then all 9 should've been taken to court no? This bit is condusing. Is this even allowed?

    If 5 cases did not go forward, or were dismissed, you'll need to find out from (possibly) the court. We won't know here.

    Waste of time. The court won't know nor care.

    If they appear at court at a later date it may be useful, but for this claim it means the square root of hee haw.

    Why do you think a court knows the commercial decision that caused a PPC to choose to issue a claim for £x rather than £y?

    You fight the claim you've got.  Who cares what the LBC said.

  • The thing is, today I received an email from Gladstones saying that they would knock £200 off the remaining 5 PCNs but only for a limited time. 
    I would rather pay off this than deal with the court for the remaining 5 PCNs because its just so much hassle and headache.
    What do you guys think?
