Default CCJ filed against me and Court Letters sent to wrong address

    I'd do it the other way - email it then wait a couple of hours, then ring them up to pay and make sure they have everything.

  • Good morning Guys!
    Thank you all for your previous replies but something more urgent has come up
    So I am trying to finalise my things today and noticed something.
    PCM sent a letter before claim for 9 PCNs but in the copy of the judgement, they have charged me with 4 PCNs. So my questions are:
    1) Why have they gotten a default judgement for 4 PCNs only when the LBC is for 9?
    2) What about the rest of the 5 PCNs? Will they go to court for them too?
    3) If the LBC is for 9 and they got a judgment against me for 4 PCNs, is there any points I can make about this revelation?

    1) who knows , only they do , or don't !!

    2) possibly !!  again , who knows ?? Only them 

    3) not yet , but if they do try again ensure that you have your data up to date and use it against them which you will be told about for that case at the time

    Nothing to do with the current situation , so get on with it

    You should get a copy of the claim form and then you can see exactly what they claimed for and on what basis.. 
  • Also, so on the draft order:
    - how long for the claim form should i give the claimant?
    - how long for the defence should i give myself?

    Leave the dates blank; the judge will fill them in, that is why it is a draft order.  Assuming that is what you mean.

    IT IS ORDERED that:
    1. The default judgment dated xxxxx xxxxxx be set aside.

    2. The Claimant to pay the Defendant’s costs of this application to the sum of £255

    3. Unless the Claimant serves a copy of the Claim Form on the Defendant by 4 pm on [date] paragraph 2 shall cease to have effect and the Claimant shall pay the Defendant's costs summarily assessed at £255 and the claim shall be struck out.

    4. If the Claimant serves the claim form as directed in paragraph 3 the Defendant shall file and serve a defence by 4pm on [date].

    5. Should the Claimant discontinue the Claim after the CCJ is set aside, paragraph 2 shall cease to have effect and the Claimant shall pay the Defendant's costs summarily assessed at £255 plus the Defendant's costs for attending the hearing in any event.

    6. That all enforcement be put on hold pending the outcome of the application.


    Assuming you mean 3&4 i'd go for 28 days in case Xmas comes in to play. Anything from 14 is acceptable. Probably put 28 but don't get hung up on it at the hearing.

    As for 2, 3 & 5, you don't need to cancel 2 in 3& 5 as you are still seeking the same amount.
