    Hi All. Update. I've received a letter by email from debt collector stating Court action maybe necessary etc..in compliance with 'Practice Direction on  Pre Action Conduct'. 
    14 days to respond. I presume, I ignore and file?

    Hi All. Back again! I have received Letter of Claim from BW Legal giving me 30 days to complete forms etc. Which i won't. I checked newbie thread,  do I have to still write to them 'seeking debt advice' etc or is the 30 days covered in their letter. ? 
    I have already done a SAR and no address issues.
    Would it be worth e mailing them to say I will await their MCOL? 
    My defence and witness statement are prepared

    I believe it is too late to state you are seeking debt advice. This only applies before a claim is made, so up to LBC but not once a LoC has been received.

    You don't need your WS yet, but it doesn't hurt to be prepared. Your WS comes much later in the process and includes your exhibits (evidence).

    Have you got pics of the site and signage in readiness. Have you shown us paras 2 and 3 of your defence yet?

    @Fruitcake, I think a Letter of Claim is exactly the same as a Letter Before Claim and as such, now is the time to tell the sender that you are seeking debt advice and so the filing of a County Court Claim must be delayed by thirty days.

    Thanks both, I'll tell them I'm seeking debt advice, but won't complete any of their forms.
    I'll get photos shortly as the actual pub/Hotel is bring knocked down.!
    I'll post para 2 and 3 shortly.

    Was the Debt Collector the fake one that is a trading name of ArdPark?  Mention it in your defence...it's a way to falsely double the parking charge. Judges need to hear about this.

    You are not at claim stage yet if you don't have a claim form N1.

    Hi coupon mad. The debt collector is BW Legal, they've sent me various forms, 30 days to pay etc, est court costs with interest etc.

    That is a "proper" letter of/before claim and you should deal with it as per the advice in the NEWBIE sticky.  Expect a N1 claim form soon (well after 30 days) but you can extend this time by sending a "whilst I deny any debt exists, I am seeking debt advice and I require you to put the case on hold for a minimum of 30 days in line with the pre-action protocol for debt claims".  Sending this AFTER you receive a N1 claim form will be too late.

    I meant in 2020, was it ArdPark using alternative headed notepaper ('Ridings Recoveries') as noted in the other ArdPark thread on here this week?

    I assume you are reading other Ardpark threads, as we are.
