Multiple unauthorised transfers from PayPal by 16 year old daughter

  • How did the daughter access the mothers bank account?  Cash has to be transferred to PayPal account from the bank account . 
    She didn’t access the bank account directly.  In the OP it states the mothers PayPal account was funded with a HSBC debit card.  So even if the PayPal account was empty, the transfers the daughter did from mothers PP account to her own PP account would have debited mothers HSBC account.

    Certainly a lesson there to the mother to regularly check her bank statement if she managed to miss 40 transactions!
    Unfortunately she didn’t have online banking and only got paper ones monthly, which, by the time she received it leaves a 5 week window.
    Shes also a Filipino immigrant who Is not great with English or to savvy with how things work, which is why she’s asking for my help with this. I’m going to see her tomorrow so we can call her bank.

    That she opened her own paypal account seems a bit of an irrelevance - if she had only been able to spend her own money from her own bank account this problem would not have come up.  And if she had had access to her mother's paypal without her own account she could still have spent her mothers money without needing her own paypal account.  The relevant issue to me is how did she get access to her mother's paypal and were there any failings by paypal in this?

    I would suggest that OP tells the mother to put some of her daughters trinkets on ebay to recover her loss and dock their pocket money accordingly.
    Your bank or her bank won’t repay it. I assume if the bank request a charge back PayPal will refund it then debit the daughters Paypal account. Then they can try to collect from her, while also acknowledging that they didn’t do their due diligence when allowing a minor to open an account.
    the daughter can then pay PayPal back.
    As an EBay seller I’ve had loads of chargebacks against me for nefarious reasons with no investigation by PayPal.

    Why can't the daughter just pay back the victim?  Why waste the resources of PayPal and the bank by getting them involved?
  • Sorry but why are you trying to pin the blame on Paypal here?  Your friend's daughter is old enough to know exactly what she was doing and why on earth should anyone be expecting any money back?  She used the money to treat herself and her friends so why would anyone else have to pay for that?  This seems entirely a family matter that needs resolved personally (since your friend does not want to call the police).  Hard lesson learnt.
