BSM Driving School - refusal to refund money due to coronavirus

Bottom line is that driving instructors are self employed and the contract is between the instructor and the pupil, if they allowed anyone to cancel at short notice without charge they would soon be out of work, it is nothing to do with anyone at BSM they do not employ instructors and cannot force any of them to reimburse someone that is up to the instructor I know as I used to be one, please stop giving incorrect advice and giving people false hopes.sweetsand said:Sprinkly said:
The instructor has done nothing wrong but I’m sure I won’t be the first and the last pupil to be in this position so do they have a policy to cover this...no they don’t.[Deleted User] said:Your contract is with the instructor, not BSM. See https://www.bsm.co.uk/terms-and-conditions/BSM are right to refer you to the instructor.I don't see what the instructor has done wrong in the circumstances.
Bottom line, IMO you have a case regardless of what some have said here in their own way and IMO speaking to some, and goodwill will win the day.10 -
The Philanthropic response would be to offer to refund the OPs costs out of one's own pocket, as a wealthy individual with a range of high end vehicles and presumably many assets and a high income, especially if that person were also responsible for raising false hopes.10

The OP needed to give more than 48hrs notice. The OP didn't. Can it be any more clearer?sweetsand said:
Judging by the OP's post, I'm not sure how you came to this conclusion as the OP has clearly stated it was a family emergency and that in anyones books takes priority and Covid knows no boundaries. With BSM being a big outfit, at the very least the co could help out or at least comprimise to an extent where OP is not being messed about.Scrapit said:Sounds like you are being unreasonable.

OP clearly mentioned emergency family situation and Covid, it can't be more clear than that. I'm with the OP.Scrapit said:

So the op gets covid and the driving instructor has to loose money because of it? Are you for real? Is he a philanthropist too?sweetsand said:

Did you not note the deal the instructor offered as the person knew that Covid is impacting most people.Scrapit said:

"is he a philanhtropist," why would I know if he is or not?0 -
Do you know what philanthropy is? He would be giving away his wage. The OP has not complied with their part of the contract in line with the agreed terms and conditions. The DI has been more than reasonable to offer another lesson for gratis. It is black and white, it really is that simple.sweetsand said:

You asked me mate if the driving instructor was one just a bit earlier so I passed your question back to you.Scrapit said:

If it was a "clear" as you claim why would the OP pose the question?0 -
Yes they do. It's just that they haven't done as major companies that aren't franchised and operated by contractors sometimes do. They haven't varied it to give extra flexibility. There is no legal requirement for them to do so, and since it it is the self employed instructor's living wage that is affected, it is perhaps understandable that they don't want to refund it. Passing you on to a different instructor passes your on to another contractor, so that contractor will expect to be paid.Sprinkly said:
