  • Thank you very much Coupon-mad, getting the app now and will finish tomorrow. I'll make sure to do plenty of reading prior to the Court phone call.
Thanks also Fruitcake, I did know about the properties thing for photos but couldn't figure out how to show that in a way I could use, so very useful.
Appreciate both of you taking the time to answer, especially so late!

If the photos were taken with a digital device they will have metadata embedded in the image files. This can be dug out by looking at the images on a PC and inspecting the Properties. If you are unable to timestamp them using the methods mentioned by Coupon-mad, then you will need to take screen grabs as you open the Properties file for each image and then reveal the time and date. It's a bit of a faff to do it that way, but the data will be there.
If it was a digital camera, I hope you made sure the date and time in the camera were set correctly.  If it was a camera on a phone, it should be automatic and therefore OK.

Good point. My digital camera is GPS enabled and records time a time and date and location, but my dashcam had to be set manually.
I hope no parking scammers are reading this as we wouldn't want them to doctor their photographic evidence ...

    Surely not.................!!!!
  • Still to do the dates on photos, so busy with work too.  Photos were taken on my iphone.
With regard to the small video clip I took, would I just attach that to the email I send with my witness statement court bundle, but still list it on the contents page and refer to it something like "please see exhibit X which is a video clip of .... and has been attached to the email sent etc"?

Any video will need to be presented on a 'durable medium' (dvd, memory stick etc) and you will need to have a device on which to play it at any hearing (or agree with the court to use a device they might have). How this works if it's a telephone/video hearing you will need to seek advice from the court.
Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

  • Ahh yet another question, sorry.  Am I allowed to refer to one of the photographs which the parking firm have included in their witness statement which I received a few days ago?  I am thinking maybe that wouldn't be allowed in case I have an advantage?
  • Thank you Keith, thats really good then.  One very last question (I cannot believe I am still working on this), should I delete the references to seeking costs if it will look unfavourable for me?  I really don't care about costs, just want it all over and done with.
