F1rst parking appeal Rejected

Hi ppl , so I appealed my charge using the template 30 days later I get a rejection letter saying the are invoking keeper liability. Do they have to send me a ntk in the post ? Or is this rejection email the same thing.

    Did you say who was driving when you appealed, This is the only way they can "invoke" keeper liability.  Why are you expecting a NTK, you appealed upon receipt of something - was it a NTD?

    Did you appeal:
    1) a windscreen charge or
    2) a charge that comes through the post?
    If 2) then you have already been sent your NtK, by definition.

    OK so the template was from the forum newbie thread, the blue one.
    In it I stated I was the keeper of the vehicle and would not be naming the driver.
    Its a van in a loading bay on private land loading, vehicle observed for 10 mins before ticket put on windscreen claiming parked in a restricted area.

    Its kind of an access road with double yellows leading to a multi storey car park for residents, but on the road are a few loading bays.

    F1rst Parking often duck out of POPLA when they see a detailed forum appeal (as per the templates in the 3rd post of the NEWBIES thread). 

    All you'd need to add to those template points in the NEWBIES POST #3, would be a first background point #1 proving that the driver was loading, therefore the loading bay was correctly used. Proof could be a receipt, work record or just a witness statement from a person at the premises where they were loading, NOT NAMING THE DRIVER BUT INSTEAD, INDENTIFYING THE VAN BY VRM - AND THE TIME & DATE AND WHAT THE ACTIVITY INVOLVED.

    Remember, that corroboration can come from any interested person (even a passenger who assisted) so would be easy to supply as your proof.  Obviously signed & dated. Not a random email unless you have no choice.

    If so, what does your lease/AST say about parking? Does it mention the need to display a permit? then it may take primacy over the self serving TnC of the scammer, and interfere with your lawful right to “quiet enjoyment” of your property, possible an offence under The Landlord and Tenants Acts.


    Nine times out of ten these tickets are scams, so consider complaining to your MP., it can cause the scammer extra costs and work, and in some cases, cancellation.

    Parliament is well aware of the MO of these private parking companies, many of whom are former clampers, and on 15th March 2019 a Bill was enacted to curb the excesses of these shysters. Codes of Practice are being drawn up, and an independent appeals service will be set up,


    Hopefully life will become impossible for the worst of these scammers, but until this is done you should still complain to your MP, citing the new legislation.

    Just as the clampers were finally closed down, so hopefully will many of these Private Parking Companies.

    Yes I have a popla code in the same email that they sent me. And that I have 28 days to appeal with popla.

    Then you need to submit a POPLA appeal along the lines that @Coupon-mad pointed out in her post at 2.50 pm.  NEWBIE sticky third post for POPLA appeal points.
