  • Hello guys, I hope that we're all good in the current climate..

    So where I'm at. APCOA have shared all of their files (separate to a zip as the zip files was not working). To be honest, the files that they have sent look fairly conclusive.
    I have received the following files:

    1. Notice to Keeper/ Hirer letters which include clear pictures of the vehicle with the time and the date - I need to check that they have all Notice to Keeper / Hirer letters vs the charges outlined in CST's letters. It must be noted that at this stage it looks pretty conclusive to be honest.
    2.In addition to this they have shared inbound correspondence between APCOA & the leasing company at the time, stating that the vehicle was on a long term lease with myself. Again, I need to check that all of the correspondence is there vs what CST have provided.
    In addition to this, I have received a new letter from CST. This I assume has been picked up again as the 30 day hold has expired. I say new letter, It is a Letter Before Claim as before, again restating the previous charges HOWEVER this time it also includes Reply Forms on .1. Whether I agree to the debt , partially, or dispute the debt 2. How will I pay. 3. Am I seeking debt advice, if so, from who etc. 4. What documents I still require or do not have, or desire to include.
    Also attached they have provided a Standard Financial Statement on earnings.. income ... outgoings ... employment etc
    These documents seem to be included which tells me that they are intending to take me to court and are expecting an outcome. However, it may still be a scare tactic.

    So to recap, the fees they have stated I owe amount to £2,890.00.
    I guess at this stage I'm looking to understand where I stand, and what I am looking to gain. Again I feel the charges are unlawful, and cannot recall all of the dates in question. What are my next steps, and where is my argument currently, and If I go to court what is my best action?

    So to recap, the fees they have stated I owe amount to £2,890.00.

    Very doubtful ...... what have CST added on top of the parking tickets ?

    Ummm... you are looking to gain by paying zero if you win and claiming some costs.

    Even if you lose, you are looking to win some of them (each and every PCN must be scrutinised and Judges sometimes throw some out).

    Even if you lose (and only 1% here lose) you are going to remove the added £60 or £70 added on top of each already extortionate £100 PCN.  

    Unless you are VERY unlucky with a new Judge, they do get it that 'costs' can't be added (only court fees and £50 legal fees can - once).

    And APCOA's Notices to Hirer did not meet the POFA requirements in the POFA Schedule 4, para 13/14 in each case anyway, so you are not liable in law unless you blabbed about driving each and every time.  The lease company naming you was NOT 'naming the driver' obviously, it was naming the lessee/hirer.

    They dont know who was driving unless you tell them
    They cannot hold you, the hirer, liable unless they met POFA2012 schedule 4 para 9 AND para 13 adn 14 every time

    Very useful information, thank you. I appreciate my response came across a bit juvenile but I just wanted to clarify the process and where I stand as I was unsure if the information that they have was more conclusive than originally expected . The driver of the vehicle has still not been established.

    If for instance I lose and the added £60-70 fees are removed , would the legal & court fees then be added? Is the legal fee £50 per ticket, and do you have an idea of what the court fees look like?

    It's the charge per pcn , which is on every PCN plus the signage , maximum is £100 per pcn , plus court and legal fees , plus some interest

    So multiply the total numbers of PCN,s by the charge per PCN , so what is that ??

    I counted 17 on the list you provided , but the PCN amount wasn't obvious so tell us what it was

    Then add the filing fee for the total amount , plus court fee and the £50 one off legal fee

    All this should be on the court claim , but they will muddy the figures by adding on extra unlawful charges

    The MCOL website tells everyone what the filing and court fees are

    would the legal & court fees then be added? Is the legal fee £50 per ticket, and do you have an idea of what the court fees look like?
    But you know what court fees look like, from any other thread and from the NEWBIES thread - really minor. It's £50 legal fees, capped for the whole claim and whatever the rate is for a £2890 small claim (might be around £110 filing fee but you know you can Google these things!).
