    Think more 'Double Recovery'.
As my letter to HX is just a SAR, I`m thinking any query of amounts due - i.e "On what Legal Authority do they have to add £60" - should be made to their legal representatives - if anyone could confirm or advise?
What are you expecting from them by way of reply?
Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

If you get any form of reply, they'll quote you the Semark-Jullien appeal. How will you deal with that?

you will find their reply numerous times on here in other cases, where they quote that Semark-Jullien case , so much so there is apathy amongst the regulars to what you are asking, its been done to death

I`m not going to bother at this stage, maybe make reference when it proceeds to a claim - after lots off (even more) reading up.

That is how most of the regulars that come here everyday feel about it too

It is covered in the template defence by coupon mad , so a defendant should understand that argument at the appropriate time
  • in addition, I have been receiving text messages sent at unsocial times from Gladstones, whilst I am aware that I am perfectly entitled to ask how they obtained this this under GDPR / SAR request - is there any reason why this would be advisable not to?

You can of course ask for any personal information of yours that they hold.

The suggestion was not to expand the SAR to include other stuff, which was your earlier proposal.

yes, I`ve corrected this now. My suggest was to submit a SAR to gladstones in addition to HX, as its gladstones I`ve been receiving the text messages from.
