£175 is in the region of a loss in court anyway...thats a poor deal for you. They dont have to pay £200 or so to a rep now2

i've just had a dispute hearing with the Judge saying that my case isn't strong and he advised that I should accept the offer of £175 instead of going to the settlement hearing and paying the full £280.You did what?
I accepted the offerPRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

... The o/p was told to accept an offer that wasn't on the table to be accepted?
Why is the court even aware of one? Is the o/p in fact engaging in mediation?
The court can suggest something is a poor case, but it cannot provide advice on an offer. A mediator could make suggestions...
This seems highly messy. I don't think the complete picture is being reported here, whether by accident or design.4 -
@Le_Kirk, @Johnersh, @Coupon-mad, @nosferatu1001,
Hello all, yes it was a mediation hearing. I have also been contacted by Gladstones today and they have said that the lowest they can do is £225. I was being pressured to accept but I put off my answer till tomorrow.
The main issue for me was getting rid of the CCJ which has been done. The offer of £225 isn't significantly lower than £275 so I'm leaning towards declining the offer even though I now think that my case isn't so water tight now. The reason being was that the Judge mentioned that my employer should have been incurred the cost instead of me. Even though the PPC is responsible for issuing permits

If it was mediation then there was no judge , just a mediator trying to reach a compromise , which is standard
Sometimes there are short interim hearings with judges to narrow the issues , which are hearings nonetheless , heard by a judge
So your replies could be using incorrect terms , confusing everyone
I cannot see the point in this negotiating of offers , either a figure was agreed. , Or it wasnt2 -
gah! THAT IS WHY WE SAY DONT USE MEDIATION!
They suckered you in
Totally. They told you exactly what we said would happen. They get paid by results. Luckily they didnt accept.
Yes, the PPC should have issued permits, your employer was responsible for making sure you got them.3 -
This is exactly why mediation is not recommended.
You say 'the judge' pressurised you into accepting an offer - pointing out that you had no case.
As has been said, there was no judge. But that doesn't matter. The point is that somehow you got the impression that someone 'with authority' was effectively judging your case and finding for the Claimant.
What a horrible experience.
Put it behind you and continue preparing for your court hearing.
The results of mediation cannot be discussed at that hearing and the mediator will not be reporting any result, or lack thereof, to the court.4 -

My worry is that if the o/p doesn't fully understand the current step in the process, she may not be up to speed with arguments that need to be presented at trial. Do read up (please!)
I can't tell you what's a good deal or what you can afford, but it is worth noting that this sum is higher than that suggested in mediation and close to the full sum which they appear to claim.3
