ParkingEye/Hospital Carpark - County Court Claim defence

Hello
Thanks for your comments Coupon-mad and Snakes Belly. As you advised a few days ago, Coupon-mad, I did send a Supplementary WS, and attached the Plain Language Commission Report, stating I was adding information that PE do know, etc, as per your comments as advised. I said Claimant hadn't included a key exhibit which PE did include at POPLA stage, ie photo of ANPR sign fixed on a barrier base. I pointed out to the Judge (and PE) that Signage Plan indicated ANPR signs at the entrance, ie on Ticket Dispensing Machine. I referred in my Supp WS to my Exhibit showing sign on barrier base and explained this image rendered Signage Plan inaccurate. If ANPR sign had been on ticket disp machine I'd have been able to read it, but as it was on Barrier Base, text was too small, making this ANPR sign illegible. I hope this all makes sense.

Hello,
I've had some good news at long last, I received a letter today from ParkingEye saying they wanted to discontinue their 'Claim' for the PCN I received at Grafton Street Car Park, Manchester Royal Infirmary. Just to recap, at POPLA stage, PE only won because they submitted old signs which were no longer there at the carpark as these signs were oddly replaced by ones which looked almost the same except had text which was half the size, thus these 'replacement' signs were unreadable and POPLA didn't notice so based their decision on the original BPA Approved template signs which were no longer there when I parked and were submitted in error. ParkingEye would have won at court stage as they were submitting a Signage Plan which was wrong as indicated there was a sign on the Ticket Disp Machine which informed ANPR was in operation, but this wasn't true as this ANPR sign was on the Barrier Base and the text was so small, the text was unreadable. PE withheld as an exhibit the one photograph which proved the ANPR sign was on a Barrier Base, not a Ticket Disp Machine. I'd already had this photograph as received it at POPLA stage so PE knew I would show this to the Judge. Its a disgrace, they threatened Court action and it was all based on 'Operator Evidence' which was all untrue and wrong. Also, looks like there wasn't a proper Contract in place as I posted PE's Exhibit Contract on here and many of the regular experts kindly commented on the irregularities with this Contract and said it wasn't likely to stand up in Court. Thanks so much to everyone who helped me with this especially Coupon-Mad who really went out of her way. Anyone who is being hounded by PE regarding Grafton St for parking events up to June 2019, ie when old parking machines were still in place fooling everyone into believing these machines were out of order, so drove away as didn't know how to pay then they'd receive a PCN from PE a week or so later. I'd be happy to share my info with anyone else regarding Grafton St. as I have lots of evidence which I've gathered, including photographs. Shame it won't all be going before a Judge!! A big Thank You to all the Regular Experts - I couldn't have done this without your help!8 -
Well done , a win due to a discontinuance by Parking Eye !!

Niiiiice! Well done. 🥂Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

Hello
Thanks everyone again for all your help. As Coupon-mad asked me to attach the photos of Grafton Street car park, Manchester Royal Infirmary, I put a pdf doc together but couldn't attach it here, so took photographs of the pages. Sorry these aren't that clear. If anyone wants the pdf file, I'd be happy to send by email. Thanks again everyone. I couldn't have fought PE off and dealt with the Defence and Witness Statement without the excellent advice and support I got here.

Thanks very much!
I have no idea why MSE have disabled the ability to upload a PDF here. Maybe it's yet another glitch of this broken 'new' forum.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
