Holypockets great you got an offer. Can I ask what you were asked to provide ie bank statements or credit reports or did you just send an email?

    Hello

I’ll post a more comprehensive guide and info into my situation, as I pulled a lot of bit from across the site and utilitied it to reasonable success when I hear back from everyone.

But, basically - I didn’t use a template or anything. I just emailed every lender with a bespoke email towards the end of January. In the email, I stated that I felt my entire lending history needed to be investigated as there could been points where the lending was irresponsible. I didn’t get any bank statements, reports, a list of loans - it’s my view thats something they should have on file and checked at the time of issue loans. If they done, it just reinforces my case.

I’ll be honest, I don’t have a lot/any info on my borrowing - and it would take ages to dig through everything to find anything relevant. I just emailed everyone one I’ve every used in the past 10 years - I still have a couple to contact, I only just remembered I had loans with them.

A point to note if you have a lot to do - keep a track of all the emails and replies. Make sure they all have logged as a complaint and you have a record of them telling you it’s being looked into within 8 weeks A couple have logged it as a query at first, then a complain when I’ve chased it up.

Also, one represetive told me the industry standard it to freeze an account while it’s being looked into - I have a few still open and it’s been quite important to stop these for 8 week or so while it’s being looked into.

Another thing I’ve noticed - I’ve had 2 back upheld, and the reason on both has been stated that I was clearly reliant on the credit as I was borrowing each month. That’s the payday loan cycle and that’s what I’ve complained about. If this has happened to you, I’d imagine you have a case. It’s cleary not a guarantee - but they both admitted they were not prudent enough checking my history and it was irresponsibe.

I total so far - I’ve got £2700 back, had 1 written off and waiting to hear back from 6-7 more. It’s not only been a nice repayment, but I’ve savwd myself about £170pm in loan payments - which has helped to break the cycle and move forward.

Thanks for that holypockets. It's very helpful. It's not for me but the person I'm helping had 30 different loans at the one time! I feel they should have did a proper credit history check before it got out of hand. I've constructed an email just waiting to get the reference numbers for each one.

Can I ask a question please. If you manage to claim back from loan companies does it put a black mark on your credit report that could effect getting any type of loan in the future? Ie labelled a trouble maker
Also person I'm helping is keen to use a claims company and I'm trying to convince them otherwise due to the commission. Any advice most welcome

I think its very unlikely any kind of black mark would be left - you are not a troublemaker - you are having a refund due to something being miss sold to you. I cant imagine any grounds for any negativity - but I'm not an expert. To be honest, if anything it should improve your credit file as it can remove things from credit files.

In terms of using a company vs not, I've had success without and i even used my own custom email. The company has access to the same tools and details as you - so I wouldn't bother. If you are worried that the claim is less likely if you don't use a company - remember you can pass on the claim to the FOS if you are unhappy who will look into it for you.
