    Hi guys

I'm new on here and just discovered these threads. I've had loads of payday loans over the past 5 years (more than £25k in total). I just wanted to know how to get started on reclaiming some of the money back. Also, what is it that I'm supposed to be reclaiming. Is it just unfair interest or other stuff as well. Any tips on what to do from scratch would be really welcome guys. Thanks

    Follow the steps:

Right, have received my final decision from the Ombudsman with regards to Lending Stream. It is the same as the provisional which I am delighted about. Just now a waiting game for the payment! Not many cases left now thankfully! Although my payday uk case is now in the queue awaiting an Ombudsman review. This is my biggest case and will be grateful once this is all over.

Thanks for the advice on here guys. Contacted 5 companies and had a reply from them all bar Wonga. Mr Lender already agreed to write off an outstanding £600 that I owe them and pay me £450 compensation. This all within 24 hours of me contacting them! Have agreed to accept this as they have been so prompt about things and because I owed them some money. I know probably could have had more if I'd taken it further but happy to have something to show for it. Will push for more on the other ones. So glad I stumbled on to this thread!!! Thanks again all.

    Hey, great news for you!

LS have disputed what the adjudicator have said with my complaint, the adjudicator haslooked at their comments and have found no change in the outcome. I will assume LS will make it go to the Ombudsman for a final decision. Can I ask how long it took from the adjudicators final decision to the ombudsmans? Would be nice to know a time frame.

    Thanks

hi, I agree totally with you. I like u got into the payday loan trap about 6 yrs ago and had one company clear out my bank account of over £1000 leaving me no money for a month. I went to financial ombudsman and they ruled the company had incorrectly charged interest twice on loans, incorrectly recorded peoples balances, illegally taken money from thousands of other accounts and many other things.

I got my money back and they were ordered to update my credit file as settled but they refused. This company was cfo and I have just had email from fca saying cfo have now been ordered to pay £34 million to customers for this illegal behaviour.

I have other payday loan companies I paid off but im thinking they were all doing the same and incorrectly charging interest and fees so if you could tell me any companies you had success with and roughly wat u asked for id be most grateful.

HI all! I've never had a loan out but my boyfriend fell into this trap years ago...and his ex took out numerous debts in his name! We're currently trying to save for a house and i'm trying to sort out his credit rating. So i went on noddle and saw that there's a payday express debt from 2013 that is still outstanding! I've done a bit of digging and i stumbled across an email from 02/10/12 from payday express saying that following a credit check he was unsuccessful with a loan application....but then on 11/02/2013 (just months later) he was allowed to process a loan and this is the loan that is now outstanding!

My fella has lived in his overdraft for years and is unable to pay this back. I have emailed the company and said that this is an unfair loan and i would like it to be written off as i don't feel the loan should have been issued in the first place. They are currently processing my complaint.

Do you think i have a leg to stand on or should we just start saving and pay it off as and when we can afford to??

    Thanks

    Hi,
My adjudicator upheld my complaint back in mid september. It was submitted to Ombudsman soon after, however this complaint was put on hold for a while as some of the loans were over 6 years old.

    Hello everyone new poster here

I have recently placed a complaint with the ombudsman for a series of loans maybe 12 or 13 separate loans which I had with Wonga over a short space of time around 4 years ago.
The majority of these loans were rolled over just to keep my head above water.

I contacted Wonga in 2015 and asked them to look into my loans and I only just read recently of success with the ombudsman that other people were having and decided to lodge my case with them.

I have received a interesting and disappointing response from them today which I don't fully understand. I don't understand what jurisdiction Wonga has over the ombudsman investigating a claim or complaint. Is there anything I can do ?

The email from the ombudsman reads

Wonga have emailed us a copy of the final response that they issued to you.

Looking at email you made a compalint to them on 12 April 2015 and they investigated your compalint and issued an response on 11 May 2015.

At the bottom of the final response it states:

This is our final response but if you’re not satisfied with it, you can refer your complaint to the Financial Ombudsman Service within 6 months of the date of this response.

From what we’ve seen so far, it looks like you contacted us more than six months after the date the business sent you their final response.

Outside this time limit, we can generally only help if the business agrees that we can get involved. In your case, the business hasn’t agreed.

We might still be able to help if there were exceptional circumstances that meant you didn’t contact us within six months.

So please let us know your reasons for the delay as soon as possible – including any information that supports what you’re saying.

Once you’ve replied, we’ll look into what you’ve said – and let you know if we can go ahead.

Please let me know if you have any questions.

    Thanks

    Hi James

Judging from what others have received and the stated criteria (on debt camel) for making loans unaffordable I would have thought you had a very strong case. As far as the adjudicator is concerned I would have thought they had a duty to inform you of any offer made even if they thought it was derisory

Thanks , quick update.Rejected offer and adjudicator heard no new offer from money shop so made a decision. She ruled every loan as un-affordable and although they stated they did credit checks she said they obviously took no notice of them as they were unaffordable regardless.

So unless they find something miraculous to counter with i'm due interest and fees back plus the 8% interest , balance wiped and credit file cleared. So for the sake of a letter and few emails been worthwhile.Hopefully puts sister company Payday UK on the backfoot too as they lent in the same period so if unaffordable for one should be for the other too.

So well worth giving it a go for anyone considering it.

How long did it take from when you submitted to FOS until adjudicator advised of their findings?

I spoke to my adjudicator 2 weeks ago forwarded the required bank statements etc. She advised that she would be reviewing over the next few weeks.
