    A pay up in 14 days or else letter arrived from Trace yesterday, the else being that GXS would get solicitors involved and CCJ
    The home/house owner is worried Trace could or may have already affected their Credit Score and want's to pay the £160, does anyone know if they have the power to do this?

    NEWBIE sticky 4th post advises all about debt collectors.  Has the house/home owner been to court and lost the case and failed to pay up what the judge ordered?  No?  In which case, no CCJ.

    There's no 'credit score' affected. It's just not possible at debt collector stage.  Imagination on steroids.

    Home owner is wrong, there is no danger whatsoever to his/her credit rating.  This is a common misconception.  I expect they also think bailiffs are going to knock on the door (what, pre-court?).

    You can't just 'get' a CCJ and wouldn't even get one if the PPC issued a court claim and the person defended (not even if they lost*, which is why we do this and we win 99% of the time!).

    Paying the unrecoverable and inflated sum of £160 to avoid the tiny 1% chance of losing in court and paying £100 plus small court fees, would be downright stupid.

    The important thing is that any OLD address is 'erased' from the PPC's database.  Nothing else needs doing.

    only 1% lose here, but if they do they just pay within 30 days and the PCN is £100, not £160, so with small court fees of £50 - £100 max there is ZERO POINT in paying £160 - just because some threatogram letters arrived.

    I'm guessing you mean if the Home owner moves address?

    What is the best way to find out if an NTK was ever sent? as the date GXS supposedly sent the NTK was left blank (see post #2 on page 3)

    The Registered Keeper can send the PPC a SAR - please read the NEWBIES FAQ sticky, second post, which explains what to do, what to send with it, to whom, and contains a link to a template to use.

    Can you confirm that what Coupon-mad said about OLD address means just keeping the PPC informed if the Home Owner moves?

    If the Registered Keeper is somebody (Car Repairers) who loaned the car out, would/should I have to contact them to see if they were sent an NTK and ask them to do a SAR? and can you/they do more than one SAR?
