  • I asked a recovery company to investigate a PPI claim and was informed by the bank in June 2019 that I had had PPI on a previous mortgage with them and that they would look into it. Neither I nor the recovery company have heard anything since (I know it is taking a lot longer for a final decision to be made so I just remained patient). But I’m December 2020 I felt I’d waited long enough so went to the ombudsman who investigated. The bank have told the ombudsman that they did send a final decision letter in June 2019, so it is now well past the 6-month time limit to contest their decision, yet neither I not the recovery company received any such letter. I’m
going to take it further with the ombudsman but wondered what my chances are. Anyone had a similar experience?

Pretty much next to zero unless the address was wrong or the bank volunteer to let the FOS consider the case (usually do not)
I am an Independent Financial Adviser (IFA). The comments I make are just my opinion and are for discussion purposes only. They are not financial advice and you should not treat them as such. If you feel an area discussed may be relevant to you, then please seek advice from an Independent Financial Adviser local to you.

If the bank has proof they sent the letter (it only needs that, obviously they don't need to prove you received it as you could just claim you never had it to avoid any time bar) then that's it unless they voluntarily agree to re-open it. That said, the majority of MPPI complaints fail as it's sold properly and protects your home so there is an obvious need for it and even things like NHS benefits aren't enough to invalidate it due to the length of the debt.
  • I have received two "here is your monthly newsletter" emails from Ingenious Legal to one of my email addresses addressed to my husband, nothing else has come through apart from that.  What is wrong with that I hear you say - a/ the email address is a competition only email address, and b/ my husband passed away 24 years ago so certainly wouldn't be able to fill in any forms.   I was going to reply to the first one as it obviously upset me to have something addressed to him but never did, the other one came in today - I googled and could see it was a genuine firm, then saw this thread so am not going to as it will only go to show it is a live email address and could lead to further unwanted communications.

Ingenious Legal are solicitors regulated by SRA and as such don't come under the jurisdiction of FOS, but the Legal Ombudsman instead.
