I had my court hearing today with VCS.
I won !
Thanks to everyone who posted on here. I’d like to especially thank gumgirl.
I based my defence on the template posted by gumgirl.
I won on signage.
I don’t want to give too much away here as I expect VCS read these posts and I don’t want to assist them.
I never responded to any of the letters or demands from VCS or legal firms employed by them.
The evidence VCS provided was a generic pack. They don’t put that much effort into providing evidence and what they did submit helped me more than them. The judge pointed out their own photographs showed the signs were illegible before I did.
I didn’t attempt to claim costs although the option was available. It was a conference phone call so didn’t cost me anything to attend.
VCS base their whole strategy on fear and the inconvenience of having to fight the case to make you pay. They don’t seem to have much going for them once it gets to court.
The telephone court appearance was really easy going. It wasn’t stressful and a bit like phoning a call centre to discuss a utility bill. It was all polite and there wasn’t any bad tempered arguing or hostility like I was expecting as you see in television dramas or films. It was a bit of a shame really as I was hoping to bang my fist on the table and shout “You want the truth ? You can’t handle the truth”.

In a way I was disappointed VCS didn’t turn up as I would like to have heard how they would argue against the 20 minutes grace period and even more about the fact I had their internal review document that stated they didn’t have the contract to issue PCNs!We went for the attendance costs even though it was a phone call as it is the least they should have to pay after nearly 6 years! The court only sent the court order letter out last week, 2 weeks after the hearing, so I am guessing the 14 days to pay up didn’t start until they received that if anybody can confirm, so have until next Thursday to pay up?3 -

What will he do ? ... timeshare, that can be a scam, holiday homes that don't exist,
How about the HMRC tax scams ? NA ... a car lot on the M25 might work, selling cars stuck in a traffic jam

Yes VCS attended the call. There was one bit where the judge pointed out it wasn't possible to read the sign in one of the photographs and asked their representative if he could read it. He claimed he could read it when you obviously couldn't. I did well not to start laughing at that point. I don't think the judge was impressed with his preposterous claim.
Shame they didn't turn up on your call. I can't have been as satisfying. I expect they knew they were going to lose once you'd not paid up and it'd finally got to court.4 -
VCS have not paid the £95 "witness expenses" as ordered by the judge at the hearing on 7th January to be payable in 14 days and confirmed in the Court order dated 21st January, although that did not stipulate a date or time period for when they had to pay it by. We emailed the court and they confirmed it was 14 days from "the date the order was drawn" and they also confirmed no application had be made for an appea.So would I be in my rights to apply to the court for bailiffs to collect it, or should I email VCS first and give them 7 days to pay up? (I doubt they would email if the boot was on the other foot). I'm thinking an email first once I know the bailiff and court costs to add in the email to them to let them know I am serious, plus a copy of the completed court application ready to be sent.I have never done this before so looking for help and advice as I don't want this scummy lot to get away with it. I looked at thewhich has a link to the N323 form to fill in for a Warrant of Control and also:-which has the costs on but I find it a little confusing.Is the cost £77 to "issue a warrant of control" or £44 "Enforcing an award in the County Court" and you don't fill in the N323 document, in which case how to do you do it? (page 13). As it is less than £600 it has to go through the County Court I have read.I just don't know how to proceed so really would appreciate some expert advice please.1

Email and give them 7 days ... they may have posted a cheque that's got lost. I'll let others comment on the Bailiff process as I don't know - although I understand your temptation to stick it up them. 😁Jenni x5
