    Okay so a quick update.

    I spoke with the majority of residents and then wrote to the management agency on Friday with a lengthy email that detailed why PCM are a terrible solution to any problem, why
    we feel there is no longer a problem (the LL is acting a year after the last complaint) and how it could cause problems for residents, the MA and the LL alike.

    They have written to me today to reassure me that the MA 'have the right to rescind tickets issued by PCM' and basically that PCM will be staying. I am going to respond and request to have these assurances in writing and for them to detail exactly under what circumstances they could rescind fines from PCM. Anything else I should request?

    "Thanks for responding to my concerns.
    In light of your email may I please ask for a copy of the contract between PCM and the Landlord which grants ______________ the right to rescind tickets issued to residents. I feel that it is fair to allow me to see a document that varies my rights as a tenant."

    I would add something about your existing rights being varied as one of the reasons you want to see the whole unredacted document. You want to know the procedure for getting PCNs cancelled. For example, do you have to go through the MA or can you just instruct the scammers to cancel in accordance with the contract?
    Is there a time limit? Is there a max number of PCNs that can be cancelled per moth/year? These are all the things you must be told about a contract with a third party that directly affects the rights of all residents.
    You also want to know about contract cancellation clauses if the PPC unfairly keep issuing PCNs to the detriment of residents and their right to quiet enjoyment.

    Do suggest all residents' VRMs and demised spaces are put on a whitelist to save all three parties the hassle. 
    Do suggest to other residents that they do the same.

    You should also ensure that visitors of residents are not targeted, nor vehicles delivering or collecting people or goods, nor vehicles on site to provide a service such as repairs or maintenance.

    I would add something along the lines of how will they guarantee my parking spot is ALWAYS available?  If someone parks a vehicle in my designated spot, will they IMMEDIATELY send someone along to remove it?

    Reply and say they can't do that and the leaseholders are objecting to this, and have not been consulted and refuse to let their rights be interfered with in this way.    PCM will not be staying.  The leaseholders refuse and the MA has overstepped the mark, and must back down because they've breached the L&T Act (quote the right parts) and must NOT allow their agents to impose parking charges on anyone on the estate and must remove the signs or the leaseholders will cover them up with binbags. 

    This is a formal dispute and PCM must be removed immediately an dall PCNs issued so far must be cancelled and/or refunded if victims have paid.  This is a private nuisance and interferes with leaseholder and residents' rights. 

    Ask for the dispute to be referred to ADR if the MA refuses to remove PCM.

    ABSOLUTELY DO NOT ALLOW IT TO CONTINUE NOR ASK QUESTIONS LIKE HOW THEY WILL RESCIND PCNS!  THIS IS NOT THE POINT.  STATE THAT NO LEASEHOLDER YOU HAVE SPOKEN TO ACCEPTS THE SCHEME NOR RECOGNISES PCM AND THEY MUST BE REMOVED FORTHWITH AND ALL PCNS CANCELLED OR PAID BY THE MA FOR THEIR COSTLY MISTAKE.
    PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

    There is only ONE lessee, the single landlord
    Everyone else is on an AST

    "Update: I have just spoken to the MA. They have told me there is only one landlord who owns the entire block of flats. All residents are tenants. The landlord instructed the MA to bring in a parking control company as, and I quote, 'a few residents were parking awkawrdly'. I told them about my experience and knowledge of these companies and the MA were clueless and asked me to put down my concerns in writing."
