Keep that point in your head for later.marticus89 said:We are afraid that this stupid fine will affect our credit score and we don't want any trouble as we are in the first stage to get a mortgage for our first house.
Keep in mind that most cases featured on this board are not lost. By 'most' I mean well over 90%.
Oh... and it is not a fine.0 -
Marticus, have you read this?
They have added what appears to be an extra unlawful amount for debt collection.
This amounts to double recovery and Judges all over the country are dismissing these spurious additions. Indeed some judges have dismissed entire claims because of this. Read this and complain to Trading Standards and your MP,
Excel v Wilkinson
At the Bradford County Court, District Judge Claire Jackson (now HHJ Jackson, a Specialist Civil Circuit Judge) decided to hear a 'test case' a few months ago, where £60 had been added to a parking charge despite Judges up and down the country repeatedly disallowing that sum and warning parking firms not to waste court time with such spurious claims. That case was Excel v Wilkinson: G4QZ465V, heard in July 2020 and leave to appeal was refused and that route was not pursued. The Judge concluded that such claims are proceedings with 'an improper collateral purpose'. This Judge - and others who have since copied her words and struck dozens of cases out in late 2020 and into 2021 - went into significant detail and concluded that parking operators (such as this Claimant) are seeking to circumvent CPR 27.14 as well as breaching the Consumer Rights Act 2015. DJ Hickinbottom has recently struck more cases out in that court area, stating: ''I find that striking out this claim is the only appropriate manner in which the disapproval of the court can be shown''.

However, VCS appealed this so it may not apply in all cases, read this

Also consider complaining to The SRA about the solicitor, if one is involved They are fully aware of the unlawful nature of most of thse additions yet persist in adding them..

I think we are all sick to death of these CST letters giving false information and asking the motorists to pay DRP ?
CST will be fully aware that DRP are a pointless company in the parking industry who also feed the general public with complete rubbish.
Both CST and DRP are members of the BPA and the BPA knows what is going on.
How can the BPA think for a moment they run a professional service when lies are par for the course by their members. The BPA is a mickey mouse club and government run with it
The BPA need to come clean and explain why they allow their members to bully, threaten and lie to the public. All this makes the BPA look very stupid and not fit for purpose
Your MP must be made aware of this and that the BPA is not in the interests of the public.
Your MP should be advising Mr Neil O'Brien MP of the same
Your MP and yourself should complain to the SRA (The Solicitors Regulation Authority) about false and misleading information.
Your MP should also copy in Mr Neil O'Brien MP, Parliamentary Under Secretary of State (Minister for Levelling Up, The Union and Constitution)
If the BPA don't self destruct themselves, their members will do it for them0 -
THE FACTS ABOUT DRP / CST LAW and the BPA

If you receive this scam rubbish, complain to your MP with a request to report them to the SRA0 -
Hi all,Another CST Law letter to add to the pile I'm afraid (see image below)!! Have read all the newbies threads etc & have sent Smart Parking a SAR & am about to send CST the "am seeking debt advice" etc email, but wanted to check potenially a key point first. One of the main themes in multiple threads is where DRP have instructed CST their agent & so-on, which is from what I gather silly mistake #1 on their part.My question to the forum experts for their comment/view is in the LBC letter I recieved from CST, they have stated they have been instructed by Smart Parking, rather than DRP. Does this present a different kettle of fish in any way e.g. is it still the SAR to Smart & debt etc letter to CST?Not sure as this appears to be a little different from all the other examples I've seen while reading throygh various forums.Any views/comments uch appreciated!!!

That is the same old rubbish from CST .... so difficult to understand that these fools think the parking ticket is £170 .. A chlid will tell you that's a lie
Are they asking you to pay DRP ????
Only way to treat CST is ....
1: Ask them for their legal authority to add fake amounts
2: If they have told you to pay DRP, ask them for the contract with DRP and yourself.
CST fail to reply because they have no answer and this dream world CST live in MUST reported to the SRA as they are not fit for purpose.
CST Law are members of the BPA and what a joke that is ??2 -
hello brothers, question asked to thousands times
i received 6-7 parking tickets from smart parking for overstaying for 10 minutes. There is a gym and the limit was 2 hours, few months ago they have put on a system where you can type your registration and it extends it to 3 hours, unfortunately it was not existing and I received ticket for staying there for 2 hours and 20 minutes. First ticket I paid, but couple of next ones I appealed by layout from newbie thread. On 4 it worked, but on one they dismissed it and gave me popla code, but I haven’t done anything with it. Then DRP letters started coming, 5-6 of them, now I received CST LAW unpaid debt reminder notice. I tried to speak with gym manager, but he said he is hopeless, once he get a ticket himself just by coming to work, which he paid half of and half paid the gym. What now brothers.0 -

Ok well next time always appeal using the POFA and you will win them all because Smart have never used that law (yet) in the decade since schedule 4 took effect.
This time ignore DRP and only take a LBC seriously.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
