lets remember scotish law and there version of small claims
on most of those cases on scotland the extra fees can be argued and beaten
in a scottish court there are no solisitors fees for claims less than £300 ,
so its going to cost them almost the £100 to find a solisitor that will work for p nuts on a case he will loose
I actually think the £300 limit should be introduced in england , its suposed to be SMALL claims and we have those parking Cos spending as much as they want to prove a point2 -

Reading between the lines (I've exchanged a couple of e-mails now with Ian B's case team) I think they're more concerned about Smart Parking than CST, and regard letters from an English solicitor as just another example of Smart Parking's routine shoddy practice. I suspect this reflects the fact that Smart Parking are 'regulated' in Scotland, and CST in England, and they see the incompetence and mischief of CST as an SRA matter. That's only my speculation, though.2 -

Good morning, I am in the same situation as the last few Scottish posters having received an LBC from CST for a ticket in Perth. I have emailed CST and Smart Parking as per the newbies thread and am about to draft complaints to the SRA and my MP. My MP is John Nicolson but I am wondering if I should cc Pete Wishart and/or Ian Blackford as well?1

dont expect anything from the SRA , or an investigation that would be concluded far after any court case you have
you can copy in as many MPs as you wish , the concensous during the telivised parking 2019 "thing" was that MPs were fed up of writing to parking cos that simply ignored them , in law , there is nothing an MP can do to stop CST or smart

but I am wondering if I should cc Pete Wishart and/or Ian Blackford as well?Over and above your own MP (and MSP) I think you should just cc the MP and MSP of the constituency in which the car park is located so they have information about what is going on in their area. You could quietly ask your MP if he so wishes, to copy your email to other MPs in Scotland, as your case is but one of a major, mushrooming national campaign of suing Scottish residents by an English law firm, attempting to deceive them via threats of doing so using England and Wales only legal powers. Many Scots will be intimidated by these unlawful threats and will be extorted of their money in fear.Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

The e-mails themselves are worth doing, though. In theory SRA should respond based on the seriousness of a complaint, and multiple identical indignant letters may have some cumulative benefit.. Complaining to your own MP may also have a positive effect in the future. As @blackdog2220 suggests, though, don't expect any immediate action.2 -

They would have sent CST a list. A few companies are using CST as it is a free chasing service, why should Smart use their own money when there is CST who will spend their own money ?
CST will make their money from the scam add on they have applied
So, that's the stupid part of the industry explained
The LBA you have received is to scare you and in normal times you would respond and of course you still can asking them to explain the fake add-on. CST don't like to answer that question.
So, logic now takes over ... CST have mail bombed Scotland to such a degree, it would take years to actually take these cases to court and if then, because of their rubbish the chances of them winning is as remote as you winning the lottery.
Now you send a SAR to Smart and request all info they have on you
Your time is being wasted so return the favour.
Pete Wishart is the perfect MP .. asking him to contact the SRA and what is the Scottish government doing about the fake claims being pumped out by CST all over Scotland

So I’ve received a letter before action for 5 of these in the space of a week in 2020. I was parking in a car park and was authorised and instructed to do so by my employer at the time. I was the driver however I have ignored all correspondence from them. I now have the letter before claim letter. Not sure what to do.0
